hello again,

i think i am getting more nervous every day with our k1 application. i have read somewhere on this site that one of the red flags for the consulate might be long period of time apart. well,we have been together 2 years now, we met in Romania, then went on vacation to Italy and last year i was in usa and lived with my fiance for 3 months . when i left we agreed that he won't come over to romania because i was going to apply for a tourist visa. i did not get my tourist visa and right after we filed for k1. he is coming over in september, but since last october we have not seen eachother, although we kept in touch daily throgh yahoo messenger, texts, mobile phone conversations, packages and all that. can anyone give me an opinion? our attorney has not said anything about this, but for the whole she said we wil be ok. what do you think? :unsure: thank you!

The key with a K-1 petition is whether or not you have seen each other in person in the last two years. Since it seems that you have done that, I wouldn't worry that you haven't seen each other since October.

hello again,

I don't think in your case it'll be a problem. You said you've met in person a couple times and were able to stay together for 3 months.

We're not made out of money and most of us can't travel back and forth as often as we'd like to.

I met my husband while living in his country, then went back to visit every 5-6 months until the last time. We decided it'd be better for me to travel to Brazil for his interview, and to come back with him, than for Christmas/New Year's like we hoped.

So we went 8 months without seeing each other.

I know we're not the only ones - and many couples have been apart for longer.

You can show proof of relationship, like you said, through e-mails, chats, letters, packages, phone bills, etc.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

This is not a problem, provide good documentation showing regular communication, chat logs, phone records etc.

If anything, the US citizen visiting when visa interview happes looks good. I did that, I visited the consulate, and asked a few questions, they recorded my presence, and I also gave my fiancee my passport to show to the consular officer at the interview.

Whoa. I agree this couple probably doesn't have a problem with time apart or number of visits but simply having met in person in the last two years covers only one minimum requirement for petition approval. The question here is about passing the interview and obtaining a visa at a US Consulate. Consular officers determining whether relationships are bonafide, concern themselves with far more than a single required in person meeting.

"Everything will be ok." is an extremely premature pronouncement.

I don't think in your case it'll be a problem. You said you've met in person a couple times and were able to stay together for 3 months.

i agree you can never be too sure, but we have everything one could ever think of , not because we made them, but because we were always trying to find new and beetter ways to communicate, we are a real couple and,as most of you probably know and feel, there is nothing worse than being apart from the one you love. that is why we are trying to cover all grounds, because we want our visa interview t be a success, not like my previouos tourist visa, which probably took a few years off my life.

The Romanian consulate has a flavor all of its own.

You are the foreign fiancee', correct? Do you speak English as well as you write?

Romania is considered a high fraud post insofar as males attempting to immigrate to the US. I am uncertain of the consulates opinion of females immigrating. The number #1 challenge I have read about (in a particularly difficult case) was the inability of the male benefiary to articulate himself well to the Consulate Official.

I do believe you will be queried stringently about the validity of your relationship. But I also believe that goes far beyond number of visits in the eyes of that consulate. If you are able to express yourself well to the CO and answer questions put to you sincerely, plus are able to control your emotions, you will be head and shoulders above many cases they see.
