Hi, I'm a medical student in my 3rd year of medical school. I met a girl and I want to bring her to the U.S. as my fiancee. I was optimistic until I ran into the I-134 form for affadavit of financial support. The thing is, my only income is student loans. I receive about 26k every 4 months, of which 12k goes towards tuition and the remaining 14k for expenses. I am unemployed. I have a life insurance policy worth 5k and a bank account of 17k. Can I succeed on my own with this or do I need a sponsor?

im fairly sure that you will need a sponsor...the loans dont count as income as far as i know...and as far as the bank account...

if you were to earn $3,000 a year,

and the minimum you needed to earn in order to qualify was $13,000

then in order to claim assets (your savings account), it would have to equal 3x the difference

$13,000 - $3,000 = $10,000

In order for it to work this way, you would have to have a savings account of $30,000

was that clear? its kinda confusing

good luck, just try and get a sponsor, your life will be much easier

When assets are used, the assets must equal 5 times the difference between the annual income and the

needed 125% of the poverty level, this is because the affidavit is in effect for 5 years. For instance, if you

needed $15,500 income and had an annual income of $13,500, you would need an extra $2,000 of assets for 5

years, or a total of $10,000 in assets in addition to your income. In general, if you are deficient on yearly income

for sponsorship and your assets are somewhat borderline, do not take chances--have a co-sponsor. If you do not

have a job or a steady income from other sources (such as retirement income), you will likely have to get a

co-sponsor for your spouse, even if your assets are adequate. The USCIS looks VERY CLOSELY at current income

and not just the assets.

You'll have to have an income of 125% above the poverty line - for two people, it's $17,112. Look at this link here for more details on the poverty guidelines.

I'd definitely recommend a sponsor that can, um, sponsor your fiancee. :)

Point of clarification: These are guidelines for the I-864 affidavit of support, which CrewPens will use when his then wife applies to adjust status. They do not apply to the I-134 affidavit of support used for a K-visa application.

Another note: how much of your money goes *out* the door and when doesn't get checked by the Embassy. They don't run a credit report or check your budgeting skills. This is largely an on-paper income inquiry.

Same situation. I used my mother as a co-sponsor. Most of the students on here do that. I just had my interview and no problems. Plan on doing the same thing for AOS.

I've known of beneficiaries to be successful at their visa interview with affidavits exactly as the OP mentions - a student with a possible bright future whose income is solely based on student loans and grants.

That being said, the Jamaican consulate may have a different take on such income. Whether they should or should not isn't up for us to debate.

The OP's best option here is to research anecdotal accounts for the Jamaican consulate (as Belwin Mills mentioned) and analyze that against the requirements of the I134.

No two consulates are alike.

yes the I-134 and the I-864 are different forms, but you still want to be sure that you have a co-sponsor if you cannot prove income. They want to be sure that she does not become a public charge and all that. It is always better to be safe than sorry too *hugs*
