We're allowed to mention Hacking on the forum. Other lawyers are recommended all the time for waivers and the like and they are not listed as VJ partners.

I am sure you are correct. Wqe are not looking to them for " strings" but for angles to approach the Embassy. Thank you everyone for all your kind attentions here.

If you didn't see the form don't worry about it. I was just wondering if that might have led to the background check. 

 

Looking at your other thread.

They might not be 100% happy with the affidavit of support... Have they requested a joint sponsor or do they only request an updated affidavit of support with documents? 

 

P.S You should try to keep all queries related to waiting after interview to one thread so other members have a complete picture of the situation.

Because your wife did not get oral notice of Refusal or for GROUNDS of inadmissibility and because they “ ghosted “ you before in the K-1 and now w I-130 insane delays, I doubt they will politely send you written notice ( Letter of Refusal w inadmissibility findings) ..

 

BUT even in cases where they DO NOT have to give written notice ( let’s say security issues) they WILL RESPOND to your Senator/Congressional Liason. 

 

This is a look at FAM ( Foreign Affairs Manual) that they go by

I would buckle down and get ready to fight as follows:

1. Do the Senator/Congressman inquiry NOW ( u can print their form from internet, fill it out, attach copy of ur drivers Licea to show u live in their district) and email it to start asap.  Make a case for  “ HARDSHIP ..as u mentioned ur age, any health issues and the risks of travel during pandemic. And ASK them to get you a Written Notice /Letter of Refusal so u can take the next step . 
 

2. Once you get a Response, and figure out what they FOUND ( ) then consult a few attorneys. ..cause u will need help…and of course reach out to this forum.
 

3. Even if Visa is being sent back to USCIS for Revocation,..the 1-800 USCIS tier officer won’t be able to tell u why ..but will tell u to wait . 
 

 

Wow, thats hard information. Yes I will proceed as you suggest. First reading the manual, thank you again. 

BTW the status on CEAC has been  REFUSED  since her interview one year ago. As stated before they requested documentation at that interview which was all provided ( tx transcript which had already been attached to !-130, other things and an additional police clearance. Since then they have requested those same things twice, and we have sent twice, including driving there and handing over paper copies. So They have not REJECTED. and staff has replied that all the info has been put in file for the CO. So I have been thinking we just has a slow CO?

Oh sorry, going forward I will do as you suggest.

An in office person who was reviewing our case for the CO evidently, and who gave the passports so Mary could have another medical, ( they had delayed so long the medical and police clearance were out of date) did say the CO said I needed a cosponsor. Evidently the officer can only read one line of a transcript. I again sent an email ( at his phoned request) explaining my actual income, with documentation, and a then current Vanguard statement and explanation of assets in lieu of income if they could not read the other. I did the math for them, showing Vanguard as 40 times the difference. The same Sri Lankan employee emailed that this had been printed and placed in the file for the CO. Late Dec. 2021.  That is the last I personally  heard. I know of no one to cosponsor as almost all my friends are also retired, or shakily self employed.....

And you are in better shape than I imagined ! Lol  Now that I know your timeline and the fact that they are just giving u a hard time on “ relationship “. No revocation on ur horizon! 

Your Officer is not only “slow” but truly abusing his powers. Get on horn w your Senator, make that  Emergency hardship claim  AND don’t forget to email the embassy yourself  saying you need your wife ‘s help to return safely to the US , u have reached out to Senator and threaten to file the Writ of Madamus!

Yes he seems to be ignoring almost everything. But you just made me feel a lot better. Having the request for assistance by my Senator printed, to sign and send today. ( I am 12 hours different at the moment)

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

wanted to say it would be a breach of any confidentality employees have to sign and i would not trust what the person said

they should not be able to get into a computer and just look at files and cases 

i just tried not to call a person out

I am sure you are correct. The only hope we had was for some direct phone number or such. Not any active involvement. The one employee when queried did supposedly say " everyone in the office is very aware of your case, and we do not understand why it has taken so long. But the issue is on the American side." 

That does not tell me much.

Everyone in the office is not suppose to know /that is also a big issue / to me a real big issue and i would raise CAIN

 

as for the comment that its On the American side would indicate the case has been returned to the US for NOIR or NOID and that takes about 6 months to hear from the US office (same one that handled the petition) 

but all this doesn't make sense as when a case is returned the embassy and staff there can no longer see it 

 

BTW the Senator can only get the same info u get 

so,  he will see the last letter or post that u see

Senator has no influence over immigration process although one did write a letter for me to our embassy / not sure it was needed as Adil was on  tax returns ,  deed to my house ,  bank account and water bill so i had started the commingling

Mary and I discussed requesting my senators assistance. Even filled the forms and signed, but we decided for now to wait on that. In our Fiancee visa we were also left hanging for nearly a year, 7 months..my then senator sent a query and the Embassy immediately rejected the visa, in an email to the Senator, but never to us.  They called Mary, told her to come in for " a few questions" and gave her the passports.  They declined to provide any reasons as I hoped is required?  They have always said everything was explained to my then fiancee, but all she recieved was her passports and the Sri Lankan secretary saying the " visa would not be issued under the current application". Mary understands both Sinhala and English, so there is little chance she missed an explanation. 

So frankly I am shy of pushing this rouge embassy unless we need to go full lawsuit. And I really do not understand what is going on either.

i never got a notice saying why our 2009 K1 was denied / its often the case
