AP is administration Processing 

and the extra security checks are for the new police clearance and other documents u had to provide

OP, I just wanted to state that writ of mandamus is a very practical option in many cases and a lot of people we have seen on Visa journey have been successful. if you are considering selling properties already for moving, WOM is a much simpler and cheaper option $10k ish. make sure to get a consultation for an attorney experienced with WOM and they will be able to weigh in your chances

There is a YouTube Attorney that apparently loves Mandamus Actions and charges $4k ..hosts a call in daily “ episode” , am not posting name cause I did not see him listed as a VJ partner and have no idea of what Vigilante Members may consider a boo boo on my part.

And when you do ask for help from your Senator/ Congressman, please ask specifically IF EMBASSY sent your case BACK to USCIS for revocation… cause that’s what the staffer’s statement translates to me…

In Dec 2022 I was allowed to return to SL and of course tried to find out want the Embassy was doing. I received an email requiring we actually print the requested info and bring to the embassy. ( that's an all day event) we did) but nothing after that. I thought we were dealing with some CO who could not read, but in desperation we have now contacted some  internal staff, ( friends of relatives) and we are told that  they also do not understand why our case is not approved, but I should contact " the American side" Where I filed the petitions.....

Would that be NVC

Sounds like the petition was returned to USCIS for revocation.  Might be worth calling USCIS to find out if this is the case, if you can manage to get through to a tier 2 rep.

Thank you, are you saying that the Embassy itself makes some effort to verify police and other documents? Why would they do that?

Thank you, I have sent a Public inquiry form, I will try to figure out how to make that call.

We are also pursuing contact through locals Sri Lankan employees of the Embassy. The phone lines for the Embassy are always "mailbox full".  Previously one unnamed employee ( through friends) advised I request an appointment with the CO, I tried, that request has been ignored like most attempts to contact the Embassy.

I am not sure what prompts that comment. Perhaps you know something I do not? 

I am retired, live on my investments drawing 50 k a year, easily adjusted at anytime.  350k in investments and 450k in property. No financial obligations, no bills and live in a very economical area of US, my small annual is still 150% of the median in my area for 4.  But it seems that is not enough? I have certainly made many, many efforts to document my financial positions to the Embassy. But perhaps they cannot understand....

I wouldn't think local Sri Lankan employees of the US embassy would be able to pull any strings that way.  Usually local workers fill lower positions in US embassies.

If status now shows “ Refused” then you won’t need to sue ( Mandamus Action) to force a decision. THEY HAVE REFUSED.

 

Because your wife did not get oral notice of Refusal or for GROUNDS of inadmissibility and because they “ ghosted “ you before in the K-1 and now w I-130 insane delays, I doubt they will politely send you written notice ( Letter of Refusal w inadmissibility findings) ..

 

BUT even in cases where they DO NOT have to give written notice ( let’s say security issues) they WILL RESPOND to your Senator/Congressional Liason. 

 

This is a look at FAM ( Foreign Affairs Manual) that they go by

I would buckle down and get ready to fight as follows:

1. Do the Senator/Congressman inquiry NOW ( u can print their form from internet, fill it out, attach copy of ur drivers Licea to show u live in their district) and email it to start asap.  Make a case for  “ HARDSHIP ..as u mentioned ur age, any health issues and the risks of travel during pandemic. And ASK them to get you a Written Notice /Letter of Refusal so u can take the next step . 
 

2. Once you get a Response, and figure out what they FOUND ( ) then consult a few attorneys. ..cause u will need help…and of course reach out to this forum.
 

3. Even if Visa is being sent back to USCIS for Revocation,..the 1-800 USCIS tier officer won’t be able to tell u why ..but will tell u to wait .
