NVC Termination Letter

Hello,

 

I (petitioner) received a termination letter from the NVC today. Saying I hadn't completed the immigrant visa application, paid feed or submitted required documents.

 

When I contacted the NVC last year (March 2020) they said there was nothing to do until the application was sent to the embassy in Ghana. I having been checking on the application periodically, and it hadn't moved from NVC, but figured the hold up was due to COVID and there wasn't anything else for me to do.

 

Did I miss something? Any advice?

After U.S. Citizenship and Immigration Services approved the immigrant visa petition filed on your behalf, the U.S. Department of State's National Visa Center (NVC) sent you instructions for:

 

·        Completing your immigrant visa application,

·        Paying fees, and

·        Submitting required documents.

 

Our records show that you did not submit these items and you have not contacted NVC in more than one year.

 

Immigrant visa applicants must apply for an immigrant visa within one year after they are notified that a visa number is available for them. Section 203(g) of the Immigration and Nationality Act requires the U.S. Department of State to terminate the registration of any applicant who does not do so.

 

This letter serves as notice that a visa number is available for you.

 

If you do not pursue your immigrant visa application at NVC within one year of the date of this letter, the U.S. Department of State will begin the process of terminating your visa application.

 

Please inform NVC of your intentions by completing the Public Inquiry Form at https://nvc.state.gov/inquiry. In the “Type your Question Below” text box, please indicate ONE of the following:

 

  1. Yes, I wish to pursue an immigrant visa, please send me information on applying for my immigrant visa. I understand I will have to resubmit all required fees and documents in order to continue the immigrant visa process.
  2. No, I do not want to pursue my immigrant visa application because I have adjusted status. (Please attach a copy of both sides of your alien registration card.)
  3. No, I do not want to pursue my immigrant visa application because I have received an immigrant visa through another petition and am now a permanent reside. (Please attach a copy of both sides of your alien registration card.)
  4. No, I do not want to pursue my immigrant visa application because I am no longer interested in immigrating to the United States. Please attach a statement in writing directing that the petition be withdrawn. An authorized representative (the petitioner or attorney of record) must sign it. If an attorney or accredited representative submits the request, and an executed Form G-28, Notice of Entry of Appearance as Attorney or Representative has not been filed; they must submit one with the written statement.
  5. No, I do not wish to pursue my immigrant visa for a different reason (please provide explanation).

 

 

If you do not reply to this notice within one year of the date of this letter, your immigrant visa application will begin the termination process. If you have any questions, please contact NVC by following the instructions online at nvc.state.gov/ask.

Your post does not make it clear to me that you opened an account at CEAC, paid the fees and submitted the required documents, before getting this letter.  Did you do these things?

 

If not, you are definitely misunderstanding the process, and you are lucky that they gave you another year.  Get it done now.

 

If you submitted those things, were "Data Qualified" and they told you to wait for Ghana embassy, and then they sent the letter, that is a problem you have to call them about.

It looks like this was for a K-1 petition. Is that correct? If so, then you should not have to do those steps and, as NVC told you last year, it will just go to the embassy when they are ready to schedule the interview. You should call NVC and confirm they have you in the right category. The steps mentioned are for immigrant visas such as IR-1, CR-1, IR-5, etc. and should not apply to K-1s. Hope you get it straightened out!

I called the NVC and spoke with them. The person I spoke with confirmed that my application was in the process of termination. However, he said this was an error and fixed it.  So I should be good . I also confirmed that I wasn't missing anything documents or needed to pay any fees. He reaffirmed that my application was waiting for the Ghana Embassy to request it--they are still not requesting K1 visa applications from NVC--and there is nothing more for me to do for now. 

 

According to the person I spoke with, I hadn't contacted NVC for a year and that is why the termination process was started. However, it shouldn't happen with K1 visa applications. FYI, my application has been at NVC since March 2020 and spoke with them last on May 5, 2020

 

Anyways, I'm not sure if my experience is an outlier or others that have their K1 visas at NVC might experience this due to longer waits while Embassies are still shut down/running at lower capacity.  I will be calling them more often after this experience though.

Typically K-1's do not stay at NVC for months on end.  I wonder if this is an automated systems glitch and more K-1 applicants will receive similar termination notices?

 

 

I assume whoever programmed their system probably never considered or tested that K-1 petitions, which have a similar case number as other visas at NVC, will trigger the auto termination notice.  It will be interesting to see if your case was a one-off or others will be caught by it as well.

It would appear they confused this with a CR1 which requires all this to be done at NVC state

and also appears the computer spit out an automatic message as they should be programmed to do this when (in normal days) a person does not keep NVC informed to keep the case open even though they haulted the process

i would send a copy of the original receipt with a letter informing NVC this is K1 and you wait for the embassy to reguest the packet along with thousands of others.  Keep copy of letter you send 

make sure the letter says
RE:  case #

      both names 

     and both DOB's  

dont' think since you send them together in same envelope that NVC will not loose one or the other in the enormous stack of documents received daily

I agree, I think this was an auto termination and message that probably was never an issue pre-COVID.

 

Thanks, for your suggestion. I will follow up with NVC, I don't feel comfortable with assuming all is ok now. It really had me scared for a minute.

it did happen then too

as USCIS asked for an increase in monies and approved but stopped so if you talk to any officer , they are working short staffed because of the budget for years / lady at our 400 interview said that
