I filed I-130 and then I-129F (K-3 Visa) for my husband in India and both were approved in October 2006. The I-130 approval mentioned that my husband can file for AOS by filing I-485 in the US though we had mentioned clearly in the I-130 that he would Adjust status in Chennai, India.

I filed I-824 in November 2006 to transfer the approval to Chennai, India. Till date this has not happened. The online processing time says they are processing Dec 2006.

In the meantime my husband was granted K-3 visa in India during Jan 2007 and was waiting for the I-824 approval.

But he had to come to the US during the end of June 2007 to prepare for his USMLE exam in September 2007.

My question is: Do I just wait for the I-824 to be approved and sent to Chennai, India(which should be very soon) and then my husband get his immigrant visa in India --is this allowed OR

Should he withdraw the I-824 and file I-485 for AOS (which could take years)

You input is greatly appreciated.

If you decide to do AOS, do it ASAP, the fee to file I-485 goes up to $1010 July 30, after that you may be further ahead to stay the CR-1/IR-1 course and wait for the visa interview in India.

Yes, I agree, do the AOS ASAP, as the fees are going up from July 31.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Yes, I agree, do the AOS ASAP, as the fees are going up from July 31.

The option is entirely yours. If you chose to adjust status in the US, simply notify USCIS that you changed your mind and are adjusting status.

For clarity, you do not adjust status abroad. An immigrant visa would be the good result. Either result produces a green card.

Thanks...the fee is just ridiculous. Just wanted to confirm if its still possible to go CR-1/IR-1 course even though my husband has entered the US with a K-3. By the way I am told that it takes a couple of years to Adjust Status through I-485 filing in the US..Is it true?
It can take from 2 months to who knows how long to adjust status at this time in the US.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Our I-130 was approved and sent to NVC and then about 2 weeks later the NVC sent me and my wife letters from NVC about naming an agent for sending documents and the fees and such to process the CR1. At about the same time our I129 was approved and the NVC sent it to the consulate. This is why we went the K3 rout becuase it was faster to bring my wife here. Anyways, for the CR1 you should have been getting information from the NVC to continue with the CR1 process.

hello ..oh I think you could give me the answer to my question..i was wondering if i can enter US with K3 and then come back for CR-1 interview.. is that my I-130 is aproved but 129f still pending..and the problem is that for immigrant visa i have to go to Warsaw for interview and for k-3 I can do it in Lithuania.. :unsure: of course I could wait for few months moore.. :wacko: but I'm sure all of u knows what it means :(

please share your experience...thanks.. :blush:

In my case the I-130 was approved along with I-129F but the I-130 said my husband will adjust status in the US. But he had to stay in India since he was in the midst of his USMLE exam and in the mean time I filed I-824 to send the I-130 approval to India. This was done in Nov 2006 and till date has not happened. My husband had to use his K-3 to come to the US to take his Step 2 USmle exam and is here now. Should I file I-485 now or wait for the I-824 to be approved so that he can go to India and get the immigrant visa..which I think will be faster.. or does the I-824 get cancelled because he is in the US and the only way out is file I-485....I am getting confused since the fee for I-485 will go up to $1010 on July 30... Any thoughts

I believe it would take more than 9 months only if your documents went missing or behind someones desk until they decide to clean up the desk :unsure:

But the usual cases take from 6 to 9 months.

06-04-2007 - Case Recieved by NVC, assigned a Case Number, and the same day sent off to the Consulate

06-06-2007 - Recieved NVC letter in the mail saying the case was transfered to the Consulate.

6-8-2007 - Case Recieved by the Consulate

6-11-2007 - Packet 4 was sent out (No packet 3)

7-5-2007 - Interview Date PASSED the Interview

7-10-2007 - Will go to pick up the visa. Thank you GOD

09-04-2007 I-485 & I-765 sent.

09-06-2007 Package was delivered to the Chicago Lockbox.

As of now now check cashed yet, and no notice of action !!! Very frusturating.
