My Spouse is from Venezuela, permanent resident of Panama.
He  Has not lived in Venezuela for over 7 yrs. He obtained a BI/B2 visa 5 years ago without needing a Police Certificate from there.
The Pre Interview upload requirement is asking for the Police Certificate.  Which usually you can obtain online.  However we have been unable to obtain one yet.  Even staying up until 3 am

in the morning on his date to apply for the certificate-the result is always the same "we have processed the limit of certificates this week (7,000 alledgedly).
According to his family everything has been closed the last couple weeks due to the new strain of Covid.  So we aren't even sure that someone is there processing at the time.
1. Is anyone else dealing with this, or has been successful in getting one recently?
2. Would this one of the items you can explain why you don't have it to upload and at least get moving forward while we continue to try to obtain for the interview?

Any experience based advice appreciated
Kind Regards

It sounds like you are talking about uploading documents at the NVC stage. It would be helpful if you completed your VisaJourney timeline.

Just making sure you have done your due diligence and read these previous VJ threads? 1, 2

And also this page from the Department of State?

And finally, this page from the NVC process which specifically says:

Important Notice on Missing Documents: If a required document is unavailable per the country-specific guidelines, you do not need to scan the document into your CEAC. However, if you cannot obtain a required document for another reason, you must submit a detailed written explanation to NVC when you scan your other documents. During your visa interview, the consular officer will determine whether you must obtain the missing document before a visa can be issued. As a general rule, any document that is listed as “available” on the country-specific guidelines must be reviewed by a consular officer. Failure to obtain all required documents will delay your case.

If that's the case what was your conclusion?

Mine is that your two options are to:

1) Keep trying to get the police certificate and upload it once you are successful

2) Submit a detailed written explanation to NVC (just like it says in the quote from above) about why you can't obtain the certificate right now (supplemented with evidence like date/timestamped printouts of various unsuccessful attempts, etc.) and upload that while you keep working on getting the actual certificate.
