USCIS Denied I751 IMPROPERLY FILED HELPPP

Timeline

I called USCIS they said they denied my application on 4/8/2021 and returned my package and check as of today I still have not received anything and i have moved i gave them updated address twice and I still have not received it. They gave me receipt number which I check status and it say Improperly Filed I asked the agent and she said don't know that my letter will tell me and I told her i have not receive it at this point im lost my husband GC will expire in a month and I don't know how to get a copy of that letter to see the reason so i can redo a package and check and send back to them.........any help?? Any suggestions please??

Your application is considered as improperly filed if you file before the 90 days window, if the check has wrong information -such as the fee-, if you didn't sign the form or signed it in the wrong field or if you filed with an expired form.

 

As you already know it was returned, you can prepare a new packet and send it as soon as you can.

I agree, the OP needs to go back and check their dates of filing (was it before the 90 day window even by one day), and review the forms they submitted (hopefully they kept a copy of the package submitted), and remedy the item that caused it to be rejected and re-submit as soon as they can.

It was rejected, not denied.  Just refile a proper package as soon as possible.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Agree with the rest. 

 

And try and use money order. We see a lot of horror stories of CC payments being rejected for one reason or another 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

There will be a letter attached to the returned packet.  It could be early filing, unsigned or improperly signed forms, or a payment issue.  Those ate the most common.

It most certainly was NOT due to needing more evidence.

It was rejected for improper filing, so it's not because they need more evidence.

You have to wait for the returned package to find out why your submission was rejected.


The most common reason for a rejection is sending in the I-751 before the 90 day window opens up.  What's the expiration date on your husband's green card?  When did you send in the I-751?  If you give us the exact dates, we can tell you if this is the problem.

The hypothesis that you filed too early isn't credible, as I cannot imagine USCIS set the issue date of the green card after the AOS approval date.

 

Assuming the green card expires 2021-05-18, https://www.timeanddate.com/date/durationresult.html?m1=03&d1=01&y1=2021&m2=05&d2=18&y2=2021 says you filed 78 days before 2021-05-18.

There will be an explanation letter in the returned package, you just need to wait for it to show up in your mailbox.

 You can refile right away, Use the i751 form currently posted at USCIS site https://www.uscis.gov/i-751

 

Follow the instructions posted at the same site.

 

Remember the conditional green card holder is the petitioner and the beneficiary, the USA based spouse is simply the spouse in an i751 application. Sign in appropriate locations.

 

Enclose the correct payment i751 fee + biometric fee together $680 total for just a green card holder, add an additional $85 for each minor child included in the i751, personal check are best, money order is good, and you can pay with credit card but if your bank does not accept your application will be rejected (banks some time flag as fraudulent transaction).

 

Likely not too early now, but you will be just fine if you get the application to the USCIS lockbox before the CGC expires. You can file late if needed with an explanation why your i751 application was late.

 

Do not stress too much you can refile fixing whatever error caused the issue.

As it has been already mentioned, you can file again now -the sooner, the better-. You do not need to wait for the letter to arrive. 

 

If you want, you can add more evidence, but evidence was not the reason behind your packet being rejected and returned. 

 

As stated in previous posts, double check if the filing fee is correct, the check is filled properly or your credit card is cleared for this transaction, all forms are signed in the correct field by your spouse and you, you include a photocopy of front and back of your husband's GC and you're using the current forms from the USCIS website.

Hi there, I would like to check with you or anyone willing to reply to my message. I don’t wanna make a mistake with the filing fee. The website says $595 and the biometrics is $85. Do I write on the check 680? or is the bio metrics included in the 595? thank you !
