Sent out I-130 from Canada a month ago. Can my spouse visit me in the US safely?

Hello VJ! I hold a GC that I obtained last August. I am Canadian and returning to the US for work shortly. We just sent off my wife's GC application over a month ago and received confirmation that it is processing.

Is it unwise to have her come visit me in the USA if she does not have a job ready for her? Has anyone here had experience with their spouse visiting them in the US while their Visa application is still processing/

Thank you!

Visiting during the process is possible, but EVERY entry into the US is at the discretion of CBP.  Any visiting spouse should be well prepared to demonstrate strong ties to their country.  I have seen Canadians denied entry for visitation.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A job?   That is irrelevant.  She can definitely be denied entry at the border for suspected immigrant intent.

Yes you can! I am currently visiting my spouse in the US (We applied in March) . I flew out form Toronto earlier this month, CBP asked me a few questions about my application and spouse. It was a smooth sailing. Good luck!

Heya! Did you have any proof of strong residential ties to Canada when you decided to cross the border? Any documents you brought with you? Thanks!

yes I brought a proof of my job in Canada (pay stubs, letter of employment) but the officer did not go that route and did not ask for any proof just for my date of return.

Cool - Thanks for your helpful replies. Last question - when border guard asked you why you were visiting the states, did you openly state if it was to see your partner? Sorry for all the segmented questions - I just wish for my partner to have as snag-free of a process as possible. Cheers.

Yeah I told them I am visiting my husband. They had it in their system because we had previously  entered the states as husband and wife so the officer knew. It’s best to be honest. I was nervous as well but as long as you have ur reciept and ties back to Canada your partner should be fine ( luckily the officer didn’t ask for any ties). good luck to you and and ur partner!

Thank you for your answer. It's been a hectic couple of months! She's going to make the trip tomorrow.

What receipt did you mean? For the airfare back?
