Hi everyone, I am in the process of getting hired by a company in the States but I haven't got my EAD yet or haven't even got my biometrics taken. I already have my NOA, but still waiting for my BIO appointment letter.

 

Does anyone knows if there is a way to expedite this? I called USCIS but they said that it has to be a job in the medical fields, I need to have a medical reason or be in the military. 

 

I do not want to lose this opportunity as it is an extremely good job, I'd appreciate in advance everybody's comment on this.

USCIS may consider an expedite request if it meets one or more of the following criteria:

  • Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to:
    1. File the benefit request or the expedite request in a reasonable time frame, or
    2. Respond to any requests for additional evidence in a reasonably timely manner;
  • Urgent humanitarian reasons;
  • Compelling U.S. government interests (such as urgent cases for the Department of Defense or DHS, or other public safety or national security interests); or
  • Clear USCIS error.

I believe you can only attempt an expedite after your biometrics have been taken, not before then. 

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.

You'd have to expedite after the bios and only if the new company will provide details of the financial loss they'll suffer if you can't work for them.  Having a job offer is not seen as an emergency.

I filed an expedite request (financial loss and job offer)  at the begining of April through my Rep, but they send me an email rejecting the request and saying my case was pending until I had biometrics. A week later I receuved my bio appointment letter, which just took place on Monday. First thing Tuesday I filed a second request, both personally and through my Rep.  Within 5 days they are supposed to either deny it, grant it or perhaps ask for evidence, altough I sent it all to the Rep with a letter of explanation.

 

I'm literally checking the online case status every 30 min no joke, I'm going insane🤯

This is so helpful! I understand your feeling! Silly question, how did you locate your Rep? I will try this, I don't want to miss this opportunity! Thanks in advance for your help!

I went to https://www.house.gov/representatives/find-your-representative and with my zip code I figured out who it was. Then on their website there was a button for getting help with a federal agency and it took me to a form where they asked basic contact info and my request. Soon after a team member contacted me asking for supporting evidence and a letter so they could file the expedite on my behalf.
