Courts are all about litigating rights.  The reason you can be sued on the I-864 is because it created a right for the person you sponsored.  You should be able to negotiate away his right to sue you under the I-864 in the divorce, if you have not divorced yet.  Make sure to get your divorce attorney to include a release of that I-864 obligation in your divorce.

This isn't how it works.  End of the marriage has no effect on the contract between the sponsor and the government, you can't "negotiate" an out on your obligations.

I wasn't talking about the part between sponsor and the government - only the part between the sponsor and the ex-.

How would you do that?

In the settlement agreement, the parties agree that the immigrant relinquishes the right to sue under the I-864.  Parties can always modify the terms of a contract later on, if they agree to.  Normally, the immigrant would have to prove their right to sue, which would be accomplished by presenting the I-864.  In this case, the "sponsor", would present the settlement agreement showing the immigrant relinquished that right.  The Court would then dismiss since there is no right being litigated.

I would suggest you contact a lawyer and fast. Since you signed the Affidavit of Support legally you have agreed to support him. However, with what you are saying maybe a lawyer can advise you what other steps you may take legally. It sounds like he used you to just get a green card. I wish you all the best but call an Immigration lawyer ASAP.
