Hey Guys,

The situation in India is worsening day by day and my spouse(USC) is pregnant here in India with me. Given the situation here and her condition she is planning to go back to the States. I want to travel with her so I can take care of her but my interview date has not be scheduled yet by the Consulate here in India. Due to the rise in cases the consulate is closed for 2 month or could be more if the situation goes worse. So I wanted to know if there is a way I can accompany my wife to the States.

Any kind of advice or suggestion would be amazing.

Thank you in advance and stay safe.

I have read the below thread But my case is kinda different.

*~*~*moved from “IR-1/CR-1 spouse visa process and procedures” to “tourist visas” - question is about visiting*~*~*

Your wife can return immediately. If you are already in possession of a tourist visa then you can come and hope to be admitted as a tourist. Whether you are admitted or not will depend on the CBP officer. You have a high burden of proof with a USC wife and a baby due, and proven immigration intent. But it’s worth a shot.

What you cannot do is use your tourist visa to come here and adjust status and “bypass” the wait for the CR-1.

If you have a tourist visa, you can come to the US.  Need a PCR test 72 hours before your flight.

I don't have one but I need to apply for one.

I am sorry I did not include that I do not have a Tourist Visa. I need to apply for one. And yes I do not have intentions to do anything as such cause I have full time Job and would love to keep it.

Is your embassy even conducting interviews for tourist visas? I assume not.

So nothing to be done until they are.

Without a tourist visa, there is no way for you to come to the US.

The US Embassy is not processing tourist visas.

There is no emergency that would necessitate granting an emergency tourist visa.

Sorry, you will have to wait until the US Embassy opens and schedule your immigrant visa.  Your wife can repatriate to the US now.

What would be a valid reason to expedite a tourist visa?  I don't see one here.

Expedite the CR1 visa appointment, not tourist, too late to edit my post but that's what I meant.

@WaitingJay I meant request an expedite for your CR1 visa appointment . That does not mean it will be approved (the expedite), but you can try.

I am a big proponent of expediting but does help to have a good reason.

What would be a valid reason to expedite the CR-1?  This does not meet any of the criteria to expedite.  There is no hardship to the USC wife.  She can leave to return to the US.  Why is his CR-1 more important than other people's CR-1?
