A careful read of the instructions will indicate that the i693 is needed by the i485 not the affidavit

Thanks for pointing it out. It should not have anything to do with the rejection but i will keep that in mind when i send it again.

Yes you can send back what they sent youbut it looks like you have several things to take care if:

1.  It's not concurrent filing, and you are not filing anything, the filing is for AOS by your parents individually, separate filing supported by i130 receipt notice.

2. Not sure how you  assembled the AOS packages for both parents, i suggest you make separate packages, one from each parent as if they are filing them separately. You can mail both separate packages in one box/envelope.

3. As said, include i693 separately not as a part of i864.

1) Concurrent filing of I-130 and I-1485 is what i meant. It is a bit tricky as i filed I-130 online

2) Yes, all the documents you see in the table above were in a separate packet  (along with the cover letter) for each of my parents mailed in one box.

3) I will include it as part of I485 but it looks like the placement of I-693 within the packet does not seem to be the issue here.

You are not filing i130 and i145 concurrently. It's not tricky. I-130 is already filed. It's that simple. So now it's just i485 along with EAD/AP. So include documents and wording accordingly and you won't be rejected this time.

I see what you mean. My cover letter says: "Concurrent filing of I-485, U.S. Citizen Petition for an Immediate Relative to Become a Lawful Permanent Resident"

So i can now see how this would have caused confusion. Instead it should have said "RE: I-485, Application to Register Permanent Residence or Adjust Status"

Hopefully, this is it. So in the cover letter, do you see any other issues ? or should i just skip the cover letter ? Updated cover letter:

Dear Sir/Madam,

Enclosed please find filing of the forms:

·         I-485 (Application to Register Permanent Residence or Adjust Status)

·         I-765 (Application for Employment Authorization)

·         I-131 (Application for travel document)

Summary of documents can be found on the next page.

Please advise us if you have any further questions related to this application.

Sincerely,

XXX

____________________________________________________________________________

And in the list of documents, i will skip the copy of form 1-130 and include I-693 as part of I-485. Anything else ? The medical reports are already opened so i presume it is okay that i return them as opened.  I will need to include the "green letter" which came with the rejection on top of the new filing as stated in the green letter.

i am thinking if i need to call them or just submit it again with the above updates?

Thanks a bunch !

Just wondering if anybody has added a statement in the cover letter to clarify that the filing fee of $1,225 includes I-485, I-131 and I-765 as I-485 is being filed together with I-131/I-765 ? is it necessary; would it help ? or not necessary ?

I am thinking of maybe adding a note in the table above that the fee is for all three applications + biometric fee as right now the table states that "filing fee and biometric service fee"

Looks like you are making it complex yourself. The filing fee of 1225 is for i485 only plus biometrics. The other two are free due to i485 filing but that doesn't mean thefiling fee is for all three applications.

Okay so i submitted the application again as per the changes from my previous post. It was received on 4/27.  Hopefully, i get the receipt noticed within two months. My parents I-94 admit until date is 7/7/2021.

USCIS previously replied (rejection notice to incorrect payment: my mistake to cause confusion as discussed in this thread) within 25 days.

since my parents admit until date is about 2 months,  what if the application gets rejected again due to a similar reason where I can file again with updated info/evidence (and it is past the I-94 admit until date) ? I presume my parents can stay as long as i file the I-485 immediately again ? would there be a case where they will have to leave the US ?

^ I had also noticed that there were initials on the documents which i returned so i am guessing they would done their initial review so maybe this time it should hopefully it should be quicker to review and they may check for what was missing from last submission.

Your parents can stay while AOS id pending which will be confirmed once you receive the receipt notice. As long as it's not rejected, receipt notice will be dated the day they receive the package even if you get it months later. As long as the receipt notice is dated before their valid stay period, they should be fine.

thanks. hopefully i receive a receipt notice this time and it is not rejected. since there are only ~2 months left, it looks like i will have one more chance to reply back with update incase they reject it again for a reason which can be corrected: it took them 25 days to respond for the first submission with the rejection from the date they received the AOS application. based on this, i am expecting a response around 25th of May. Lets see. *fingers crossed*

  • 2 weeks later...

Wanted to share an update that my credit card was showing pending charges yesterday morning at around 7AM from Chicago lockbox ($1,225x2). This was followed by SMS notifications in the evening with receipt numbers. I would take that as good news that the application was accepted based on the initial review. I received 12 notifications which i am guessing are for I-485, I-765, I-131..(and for both my parents). It says that the official receipt notice will be mailed.

It took 16 business days (3 weeks) to receive the reply from the date the AOS package was delivered.

I would now presume that my parents can stay in the US until they receive the approval for I-131/travel document. It would be a waiting game to see if i receive any RFE/s / receive biometric appointments.

Thanks all for your support and guidance.

@arken Appreciate your feedback here and wanted to thank you again !
