Urgent Help: Application rejected because of "incorrect payment amount" for I-485

 Share

Recommended Posts

I had filed I-485 with supporting documents for my parents (list of docs below). I had previously filed I-130 online and this would be concurrent file as my parents are in US on B2 visa.

·         I-130 (Petition for Alien Relative) – Filed online

·         I-485 (Application to Register Permanent Residence or Adjust Status)

·         I-765 (Application for Employment Authorization)

·         I-131 (Application for travel document)

I had submitted G-1450 in the amount of 1,225. Is that not the correct amount ?

There was a separate G-1450 in the amount of 1,225 for each of my parent.

The I797-C form states the following reason for rejection: "The payment amount is incorrect or has not been provided".

The entire application (with all docs) was returned and request is for it to be submitted again with the correct payment amount.

They also included a rejection notice for I-130 which i had filed online with the reason for incorrect payment and one or more of the following fields were not completed : Your Family Name.

This does not make sense since i had filed and paid online for I-130. I checked online status for I-130 and they are still under review.

There is a separate rejection notice (I-797C) for I-131 and I-765  for incorrect payment

I am confused now.

The returned copy of I-130 petition (which i had filed online) also includes three orange pages after page number 12 stating "missing page". I had submitted a copy of the I-130 petition only (not the supporting documents) as it was uploaded online.

The address i submitted was

I485 is $1225.  What category did you use for the i765?  What did you provide as evidence of a filed i130?  This is one of those situations where a paper filed i130 and included with tbe other applications would be better

$1225 should be the amount for I-485+I-765+I-131 as it was filed together ?

I-130 was filed online and i have confirmation via email that the payment was received. I had submitted "I-130 Receipt Notice (Form I-797C) as the evidence of I-130 being file along with the copy of the application which was downloaded from USCIS website. The I-130 receipt notice states that the payment in the amount of $535 was received.

I see in the I-765 application that the category is mentioned as  245 c 9. I presume that is what you were asking. In the rejection notice it states Eligibility Criteria to be C09. And the reason for rejection for I765 is also "payment amount is incorrect or not provided"

Once I find out what needs to be corrected: can i submit the documents which were returned as is and include/update/correct what is missing ? The medical reports which i had submitted have been opened ? Can I submit them as is ?  The applications seem to have been stapled together (example: I-485 is stapled together and so on).

Do you mean you included just the i130 receipt or the copy of entire i130 application along with AOS package?

I see the potential issue. As soon as they saw the i130 application package, they looked for it's fee that resulted in the rejection due to incorrect fee. They were not gonna sort thru your documents to see if it was already a pending i130.

Best is take out the i130 package and resend the AOS package back with just the i130 receipt notice.

Yeah. I guess so. I had the I-30 notice first and then the copy of the application. Would you suggest that I reuse the documents that I received back and send it as is without the I-130 package ? How about the medical forms since they were opened ?

I saw on the forums people submitting it as part of I-864.

I know the tax transcripts are preferred but W2/return was readily available for me.

A careful read of the instructions will indicate that the i693 is needed by the i485 not the affidavit

Yes you can send back what they sent youbut it looks like you have several things to take care if:

1.  It's not concurrent filing, and you are not filing anything, the filing is for AOS by your parents individually, separate filing supported by i130 receipt notice.

2. Not sure how you  assembled the AOS packages for both parents, i suggest you make separate packages, one from each parent as if they are filing them separately. You can mail both separate packages in one box/envelope.

3. As said, include i693 separately not as a part of i864.
