Actually that might help, at least you have someone to divorce, obviously this time legally, and then you can remarry.

I don't know what that means......was the divorce decree you submitted to USCIS fraudulent?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

See this note from the Department of State :

"Comments: Documenting a legal divorce is problematic.  Each type of marriage listed above has its own legal process for obtaining a divorce, thus it is essential to first understand what type of marriage took place before determining what documentation is acceptable to prove that a divorce is legal. "

 

Again, you would need to provide more details, and I suggest you seek legal counsel.

I'm calling this early. This was done for GC purposes. OP will soon be back, trying to petition for the original wife and kids after he gets his GC and divorces USC. This pattern is so common that I can smell it an ocean away.

Without dates and more details, it is not clear that he arrived to the US while married.  Big mess.

Well I assume he was married before he got the B2 otherwise there are other issues.

I got it from his storyline. 

 

Nonetheless, him obtaining B-2, then trying to divorce before arriving in the US won't fly. This is gonna be even more suspicious and an IO will be really interested in this. Anyway, he wouldn't then need to pay someone to take care of his divorce. He could have handled it himself while still in Nigeria.

 

Additionally, tourist visa is valid for a long time. I know the period authorized is what is short. So had he entered single, wouldn't it been wise to go back home after the authorization period is up and come back freely again?

 

My bet is that his overstay was because he was probably arranging his marriage to USC or had got married right off the plane and was doing the "180 day or so myth" that people keep talking about. 

 

My money is on still on the table that this is a GC marriage. OP knew what he was upto.

Possibly catastrophic issues.......time for a very expensive immigration attorney (and even that might not be enough).  He has issues in Nigeria as well as the US.

I would recommend you write it own.

Dates and timeline of events for January 2016 and back it up with evidence

If you can honestly and easily convince yourself of that the timeline is true and correct in less then 5 minutes, then hire a lawyer to assist you and you have a little chance.

 

Else hire the lawyer and get assistance on how you should proceed.

 

Either way you will need a good lawyer to assist you out of this 'entanglement'
