K1 Can I pre-empt an RFE?

Hi all,

Sorry if this has been asked before (I did try to search but couldn't find the same question). We sent our K1 application in October 2020, before I discovered VisaJourney, and in our letter of intent(s) to marry, we didn't write '...within 90 days of arrival in the U.S.'; I wrote "intend to marry in 2021".

I'm thinking we will likely receive an RFE (or would that be considered an RFIE) but am wondering if it would be worthwhile to send it to USCIS now.

Is this something that would help the timeline of our petition or should we just leave it and wait for the RFE? I'm not sure if sending additional paperwork after the initial filing is encouraged or discouraged.

Thanks for any feedback you may have.

You can certainly try.  VJ conventional wisdom says it is usually futile because any subsequent document sent won't necessarily be paired up with the petition.  But, I am one of the lucky ones who successfully sent an additional item that was missing and would have gotten us an RFE.

Just make sure that you attach a copy of the NOA1 and write a concise cover letter explaining why you would like it to be added to your petition.  Don't send it to the lockbox, but to the Laguna Niguel, CA address for the processing center.

Good luck!

Oh thank you so much. I appreciate you sharing that. Think I will give it a shot.

Best case scenario is you save a few weeks or even months by not getting an RFE

Worse case is you lose a .50c stamp.  I would try it....Good luck.
