Delay NVC processing

Hi! Couldn't seem to find an answer to this...

 

So we applied for my USC wife's parents around the new year. At the time, with some covid uncertainty and other things going on we wanted to at least start the process. Honestly thought it would take longer. Got notified this morning that the cases were approved. As far as I'm aware, the I-130 approval doesn't expire, but they aren't quite in a position to be able to move within the next year. I'm assuming the process hasn't changed a ton since we did my wife's visa 5-6 years ago?  I figure that we can drag our feet a little bit and that the NVC has some backlogs. But is it possible to just not apply for the visa and delay processing for a little bit? Maybe a year? Just don't want them to think we've abandoned the case. 

 

Of course I know the other option is to have them finish processing, move over long enough to get their green cards/ssn/etc and then go back (for less than a year) to tie up loose ends. But didn't know if there was a way to just put the case on hold with the NVC once they receive it.

You can drag the process out for YEARS.

 

As long as you contact the NVC within 12 months, the cases will stay open.

 

You have a year to pay the DS-260 and I-864 fees.  Delay paying them for 10-11 months.  Once you pay them, it starts the 12 months clock again to submit the forms.

You can just let the cases sit at NVC.  Contacting NVC once a year will hold them there.  Otherwise, they could complete the process, enter the US, then immediately return to their home country to tie up loose ends.  They don't have to wait for the plastic green cards.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There’s two over in the UK forum you might want to join up with to compare progress going through Embassy in London. One started a year before you and the other 2 years. No interviews yet. I wouldn’t hold up at NVC. There is a real backlog of cases there for London because of county lockdowns and limited visa survives.  They can reschedule their  interview and hold up in London if needed.

The reason for the delays was Trump's ban on the IR5 category from April 2020 to March 2021.  That ban has been lifted.  The ban has created a backlogged.


The worldwide pandemic has drastically altered immigration timelines and it's impossible to guess how long waits will be on any particular case.

Yes that and London has had limited workers on site and even spouse visas are only slowly being processed in London because of their limited services. They haven’t yet announced when they will go back to full service. I think part of it will be Boris Johnson eventually opening up restrictions after their extreme lockdown. Example of recent opening—Mum got to have tea outdoors in her garden with two friends not in her “bubble”. Because she lives alone, she gets to be in a bubble with my sister and her husband for indoor things.

It is much slower than it appears! We were approved in good time for the I130 and pretty good timing at the NVC but this is the big wait now.  They haven't interviewed for IR5 in over a year so I think we are in for a long wait.  I agree with everyone else and completing your paperwork and then delaying the interview if it comes to it.

11/22/05 NOA2 received (65 days)
12/05/05 NVC received application! (say 2-4 week wait)
12/13/05 Found out forms were sent to London on 12/08/05!
12/20/05 Packet 3 received!
01/11/06 Medical - Knightsbridge London
01/18/06 Sent back packet 3!
02/15/06 Received packet 4!

02/13/06 INTERVIEW DATE 03/22/06 AT 10.30AM!! - APPROVED

Married July 29th 2006!!

08/17/2006 Filed for AOS and EAD
08/26/2006 NOA1 received for both (dated 08/24/06)
09/06/2006 RFE email.....not sure what for yet!
9/07/2006 Biometrics completed
10/13/2006 Transferred to CSC!!
11/02/2006 Approval email received!!
11/08/2006 Welcome to USA letter arrives!

11/13/2006 GREEN CARD RECEIVED - NO MISTAKES!!!!

06/06/08 Family moved back to UK!!

Husband gained UK citizenship September 2015
