Hi All,

 

I just found this thread and could use some help! 

I'm a US citizen married to a British citizen and have been in the process of getting him a green card so we can immigrate to the US. My timeline has been as follows:

  • March 2020: filed the I-130 before the London Field office closed
  • July 2020: received notice that the petition was approved
  • September 2020: Received case number LDNXXXX
  • February 2021: Submitted DS-260

I've read that several people in this thread were emailed an invitation to interview, but we've not heard anything. I thought the letter confirming the case number was enough to schedule an interview? Also, a number of people in this thread said they've been "DQ" -- what does that mean?

 

I thought the next course of action would be:

  • Undergo the medical examination
  • Schedule interview

Is there anything I'm missing?

Hi, DQ means documentary qualified. So I assume all documents have been uploaded to NVC? If so, and they have been accepted you would have received an email or message confirming that the NVC has accepted all documents.

once this is done it’s just a waiting game as the NVC will schedule your interview at the embassy.

if you became DQ in Feb 2021, looking at the current timelines you are probably looking at an interview June/July.

You will be notified by email of this date. Once that is done you will schedule the medical appt and husband appears at the interview with all original documentation.

they then decide pretty much on the day whether visa is approved.

Thanks so much for your quick reply! So he has to go through the NVC even though his I-130 was accepted by Direct Counselor Filing that was submitted in London in March 2020?

Oh! Sorry i must have misread. I am not sure about the direct counselor filing process. @Wuozopo is the in house expert in this forum. He may know.

First off, this DCF question should be a new topic. Your process is different. 

DCF pick their own interview date off the calendar. Did the Sept 2020 letter tell you to go to the website for your instructions. Some overlook that. I think you could have booked an interview 7 months ago, but I’m not looking at your letter.

thanks so much for your help. i think i've been an idiot and have been waiting to receive an invite to the interview after we filled out the DS-260, but am now realizing we should have proceeded with the medical and then booked the interview.

what do you mean that i'm past time? is there a time limit on after you receive your case number that you have to complete the entire process? i'm worried i've messed this up by not fully understanding it...

A year of no contact.  You contacted in February 2021 so it right now is one year from then

I meant you could have done DS-260, booked interview, followed by booking Medical months ago so past the time when you could have acted so get on with it. Whether you have a letter or not, proceed with the instructions and find an appointment. You don’t need any special embassy letter to show anybody. The calendar is not populated much anymore but the last of the DCFs said refreshing daily will eventually show something. 
 

Pick your interview appointment first, then call medical office for an appointment. They always have something without much wait. Attend at least a week prior to interview. They will want to see the interview appointment confirmation at the medical
Prepare for medical now. Read what to bring.

Thanks very much! Part of the reason for the delay was I got pregnant a few months after submitting the I-130 and by the time I received my LDN case number, moving while pregnant in the middle of a pandemic wasn't on the table so I didn't proactively pursue completing the application. My baby was born a couple months ago so now revisiting this as I want to be near my family. 

 

As the US citizen, I just need to bring my latest tax return, right? I've got a bit of an issue as I thought they were being filed for me, but haven't been since 2016 so I am filing those now. If they're not accepted by the IRS by the interview date, I just need a letter stating why, correct?

 

Also, I've yet to go over the I-864 in earnest, but my understanding as a family of three we'll need the minimum poverty income x 3. It's likely my husband will keep his job and move his position over to the US which would meet that, but if not does having assets in the UK count? Or do they only look at US assets?

 

Finally, once the visa is approved, is my understanding correct that we have up to six months to move?
