Case inquiry for I-751 outside normal time processing.

this has nothing to do with approval or denial. it gets your adjudication. cases are processed the same way.  no penalty for filing in court.

So lets assume the RFE  response is there. That is fine but a background check is not complete. So you go and force them to make a decision, which will be a denial because they can't approve it without that pending background check. It is very bad that the whole process is a black box and we don't know if it just sits there or waiting on something which is not necessarily an RFE.

 

Anyway I am just trying to point out that forcing a decision will not be necessarily the best option to try. 2 years doesn't seem that much based on what I saw on this site so probably would I would not try to resort to the last option.

that is incorrect. Case will not denied /rejected just because you took them to court.  They cannot reject because USCIS did not do the background check. it will turn ugly when they face the Judge. Case will get denied if there are issues with your I-751 application or any issues that anyone will the documents.  

 

2 years wait time is not long is your personal decision. You might want to wait 10 years to get a decision while others dont have that much time to wait.
