Hello Community

I have a Bachelor in Forensic Science from the UK and also a Indefinite Leave to Remain (Settlement Status).

I would like to apply for a US Green Card under the category "third preference immigrant worker"

How can I obtain a US Green Card from outside the US.

1) What petition do I need to file? (is it Mandatory, if yes can I fill it out myself?)

2) If I am outiside the US, is the I-485 form applicable to me. I saw that a lot of fields will be left blank by me so I am assuming there is a different route?

3) What application steps are applicable in such case?

I am looking forward to your assistance.

Thank you

As you were told in the other thread, you would need to be petitioned by a US employer, which is typically done through an employer's lawyer.

No, the I-485 is not applicable in your situation.

Will the I-140 petition be applicable for me?

Who would be petitioning you?

If you are referring to the EB3, I believe you have to have a petitioning employer.

OP,  go to this link and read.   Labor certification and a permanent, full-time job offer required

Wouldn't I be able to fill it out myself? I'm 26.

What is the purpose of the petition anyways?

Did you go and read the link to the USCIS site?

You cannot petition yourself for a work visa.  You need an employer to petition you after hiring you.

If you met this then I guess you could try I- 526

To qualify for the EB-5 program, a foreign investor must make a minimum capital investment into a new commercial enterprise that creates and/or preserves permanent full-time employment for at least 10 qualified U.S. workers.

You may be eligible to be classified as an EB-5 immigrant investor if you:

  • Invest in a new commercial enterprise, which is any for-profit activity formed for the ongoing conduct of lawful business that was either:
    • Established after Nov. 29, 1990; or
    • Established on or before Nov. 29, 1990; that was:
      • Purchased and the existing business is restructured or reorganized in such a way that a new commercial enterprise results; or
      • Expanded through the investment so that a 40% increase in the net worth or number of employees; or
  • Invest the minimum amount of capital required, generally $1.8 million, for the location where the commercial enterprise will be principally doing business or creating jobs or $900,000 in a targeted employment area investment.

The purpose is for a US based employer to sponsor you for an EB3 based visa, so it has to be filled out by that employer.

I reckon actually this is more suitable : I-526, Immigrant Petition by Alien Investor

In your first post on this thread you mentioned "third preference immigration worker" which is an EB3.  If you are talking about an investor visa (EB5), which appeared to be the direction in your other thread, then the process is entirely different, but from what I can see fairly demanding and time consuming.

EB5 would seem the obvious option

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
