Hello and greetings to you all,

I am an American Citizen who have filed a spousal visa for my husband. My husband already went to his interview at the U.S. Embassy in Trinidad and Tobago on December 4 ,2020 . The only thing the Immigration Officer stated is that he needed a joint sponsor since I do not meet the income requirement for my husband. We found a joint sponsor and we sent the  documents requested. Immigration refuse the joint sponsor because they also do not meet the income requirement, their income for that year was $10,200.00 . 

2ND JOINT SPONSOR :

We then found a 2nd joint sponsor and we sent all the documents requested by the US. Embassy (I864 , Tax Transcript, file jointly with wife W2, US ID) 

Immigration is now asking for the joint sponsor's wife since they filed jointly for 2020(w2,  immigration status and I-864A, marriage certificate) I spoke with the joint sponsor and he told me that his wife does not have a w2 that she works freelance as a baby nurse , and as a wife she is a home maker. Their INCOME combined will meet the poverty guidelines. 

The husband's income was $65,300.00 on the transcript their total income per computer is $95,300.00 

THE JOINT SPONSOR WILL HAVE 5 PEOPLE TOTAL INCLUDING MY HUSBAND. I am not sure if the person at the embassy knows what they are doing! We don't understand how his annual income of $65,000 is not sufficient. 

I NEED TO KNOW THE FOLLOWING :

  1. if the wife does not have a W2 and there is no 1099 . The only record of her income was on the transcript that the husband provided for 2020
  2.  Can we use both sponsors for income, the husband and wife filed jointly and the first sponsor can I use their bank statement as assets?
  3. The 2nd sponsor sent me a letter to attached with his wife documents explaining why she does not have a w2

CONCLUSION

Will not having a W2 for the wife hurt our case? Do we still have hope if the Joint sponsor does send a letter to immigration explaining why his wife does not a W2. 

HOW CAN WE WRITE A COVER LETTER EXPLAINING ALL THIS TO IMMIGRATION. ANY TEMPLATE IS APPRECIATED. THANK YOU

No.  Not everyone receives income that is reported on a w2.

The person at the US Embassy knows what they are doing.

 

For a married Joint Sponsor, the US Embassy will want an I-864a from the JS's spouse.

 

1.  Highly unusual to be making close to $30,000 without a 1099.  If the tax transcript is all she has, then that's all you can provide.  You may be asked for more info.

2.  You can only have one JS for your husband.  The wife is the Household Member of the JS.  The first JS is not a part of this since their income is insufficient and can not be combined with anyone else's income.

3.  That's fine.

 

Not everyone has W2 as an employee.  As a freelancer, she should be getting 1099s.  

There's no template for this.  You write a letter explaining your situation.

They’re just asking for an I864A filled out by the spouse.

If she’s considered “self-employed” which is what freelance usually is the entire tax return with all the schedules is usually required, not just the IRS transcript
