Only option at this point is for mother to visit USA on a visitor's B-2 visa, she would file for it at the Embassy or Consulate, using DS-156.

You cannot petition for an immigrant visa for her, you need to be a US Citizen first.

Immediate Relatives of U.S. Citizens (IR): The spouse, widow(er) and unmarried children under 21 of a U.S. citizen, and the parent of a U.S. citizen who is 21 or older.

B2 is for Visiting, if she applies on the basis of helping your wife and new child she is very likely to be refused.

B2 usually will have 6 months stay period when they get in.

If necessary, it can be extended for another 6 months by using I-539.

But giving the situation, it may be hard to get B2 visa.

She can try it if she has strong tie to her home country, but it should be done by herself - your mother-in-law -.

You can not help her much.

You may want to check with immigration laywer for possibility to get H1 visa for her.

But since H1 visa quota was running out already, it is slim chance to get it because you have to wait for Oc1 to file it.

Horribly wrong.

What's wrong about this ?

I just pointed out that he can use H1 to sponsor his mother-in-law for temporary baby sitter or house maid.

Yes, I guess it's not H1, actually it is H2B using I-129 form.

I guess you answered your own question.

Next the chances of getting a H2 in these circumstances...

Is pregnancy seasonal I wonder.
