USCIS Processing Times

Hello Everyone!

Somebody please explain to me what is going on with USCIS processing and approving K-1 cases that have been sent in September and November but earlier ones like August they have been ignoring. Our date that they confirmed and received was August 22, 2020. Why is it that more recent applications get approved quicker than ours.

Second question: We already sent inquiry for case outside normal processing time and they answered that there should be a response with 45 days. Is it true that if you constantly contact USCIS by yourself or approach your senator/congressmen, then USCIS delays the process even more or cast it aside. What would be the appropriate course of action to take if we did not hear anything past the 45 day timeline?

Feel free to share any of your knowledge or past experience!

Hi Anna,

I can understand your frustration. Checking the case tracker app everyday makes me even more concerned. I am not sure why they are skipping around from september and november and leaving late august filers "hanging in the balance." Also I do not understand how they brought processing time down to 5-7 months when the only people that seem to hit that mark are the small portion of November filers.

My theory is and again only a THEORY... is that someone on the team got COVID and now majority of the officers that process K-1s had to quarantine for 2 weeks. Cause its funny how in March they were flying through K-1s and now since April it has been lagging!! JUST MY THEORY!!

I hadn't even thought of that, but it would make a lot of sense. It is super weird how slow and sort of chaotic it got the last few weeks.

Someone on a group I am was NOA 9/8 and they contacted their Senator when they got out of processing time. By the 12th they received a response from a representative who stated that an officer was assigned their case. It is worth looking into.

As for the skipping around, my guess and its only a guess based off the data dumps with percentages based on NOA date and case number that once they get below a certain threshold for that group they move on. So it seems slightly better if you get your response either before your outside date or a days/week later.

Our Timeline:

i29F Sent: 9/17/20

NOA 1: 9/21/20

RFE: 4/14/21

RFE Response Sent: 4/22/21

RFE Response Received: 4/26/21

NOA 2: 5/10/21

Interview Date: December 10, 2021

I was skipped as well in my case. Everyone’s approved but ours is in the middle probably forgotten.
I understand your frustration deeply. We aren’t sure what to do. I did submit an outside processing time inquiry which we are aware may/may not do anything and have written to my Congressman. There isn’t much unless there is a literal life or death situation or in the governments interest.

I was wondering this too.  Those lucky people in November that got approved before everyone else...they just saved a whole lot of time being able to schedule an interview now.  I'm happy for them, but I can't help but feel sad with how broken our system is.

K1 process:

  • 10-28-2020 - i-129f Received at Lockbox

  • 07-06-2021 - NOA2
  • 08-19-2021 - Arrived at Embassy
  • 10-07-2021 - Checklist received
  • 10-21-2021 - Interview & Approval
  • 12-29-2021 - Marriage :)

AOS:

  • 01-29-2022 - Package sent to Phoenix Lockbox
  • 02-02-2022 - Credit Card Charged
  • 02-12-2022 - Notice of Biometrics
  • 03-09-2022 - Biometrics Appointment

Another reason to be upset, I-130 filers for step child and petitioner is USC, has a longer processing time than LPR.

if you rely on their processing times that they publis than i have an ice bridge to sell to eskimos. Think of Trash and its the same as USCIS processing time but dont remind them of it and they get annoyed and find 5000 reasons to dish out.

We were waiting for our approval for 573 days!!!! HELL!!! We called million time to USCIS and spoke with tier 2 or 3, sent letters to Congressman several times. Such a long journey:(

Wow you are a trooper for sure,  ours was long, but not as long as yours. Proves you just have to wait it out and not go crazy doing it. Good job my friend!!!

4 years, 11 months, 2 weeks and 3 days

Citizenship Complete!

USCIS is like a box of chocolates, you never know what kind of answer you are going to get!!!!

So who do we contact, Congressman or Senator?

Unless you're in a very low population state with only one or two US House Representatives, you should normally contact your Representative first when seeking congressional aid, as he or she has far fewer constituents to deal with and there's nothing Senators can do that Reps can't for this purpose.
