Form I 131 and AOS filled separately

Hello everyone!

 

I see mostly everyone when doing their AOS they file forms 485, 765 and 131 altogether. I get this is more convenient and cheaper. So when you get your Temporary work permit card, this serves as advance parole. 

 

However, is it possible to file for I 313 separately and recieve the AP way sooner?

if you apply for i-765 and i-131 you will get combo card .

 

your i-765 work permit is not advance parole if it does not says also valid for reentry.

 

if you dont apply for i-131 and only apply for i-765 than no you cannot use to reenter as the card is only for work authorization.

 

applying separately does not get your i -131 faster. every day there are several applications. so the sooner you get in line , the faster your application gets processed.

On what basis would you qualify for advance parole if you have not yet filed for adjustment of status?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Same as filing all together? Isn't it the same form? Just filed lets say, a week later witha processing time of 3 to 5 months instead of 4 to 10.5?

I think I understand what you mean and what you're trying to do, but correct me if I'm wrong. I didn't file for I-131 with my original package (sent out in late September) because I didn't think I would use it, but then I got hired for a research position that might require international travel (I was on F-1 international student status, so I could accept this job as it was through my school). So I filed for AP after I got my bio done on 01/05/21, got IOE receipt numbers on 01/17/21, got a biometrics reuse notice on 01/25/21, and my stand-alone AP was approved on 02/09/21. I had my AP in hand by 02/16/21, before my EAD card, which I had applied for with my original package and didn't receive until 03/04/21.

 

So I guess what you're asking is possible. Also, AP and EAD are free if you have paid the AOS fees. You just need to attach a copy of your NOA for your AOS with your I-765/I-131 applications.

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.

You can't apply one week later because you have to wait to receive the NOA1 from AOS before you send a 131 separately, and that's gonna take at least 4-6 weeks.

where does it say 3-5 months if you apply AP separately ?

No, it does not.  EAD and AP are separate.  If you apply for them concurrently, and they are approved concurrently, you will receive a "combo" card.

 

You cannot apply for either one without either concurrently, or previously having applied for AOS.  Having come to the US on a K-1/being married to a USC is not an adequate 'basis' on which to apply for EAD/AP.

That's what I said. It's a combo card I know. Technically It's the work permit which says ''Serves as advance parole''.

 

So It's an option to file for AOS and EAD and when you get your NOA1, apply for AP and getting it potentially in half the time.

They are separate entities.  Not all EADs come as combination cards.  Some EADs specifically state they are NOT valid for re-entry.  I have seen it several times.

That's the case I you file for EAD but not for AP
