NBI Explanation Letter (221g)

Hi can anyone give advice or answer my question. HIghly appreciate your help.

 

My dad was interviewed last October 2020, for Ir1 visa - spouse of US citizen. His visa was Refused. He needs to submit an NBI Explanation Letter.  The following day he went to NBI Manila office but he was told that NBI needs a request letter from USE-Manila. We did called USE-manila but there was no answer at all. 

 

January 2021 , we emailed USE-Manila. They replied " Please be informed that we are unable to predict how long it will take to receive the information we requested from the NBI.   Be assured that we will notify you once we receive the information directly from the NBI and complete our review of the case."

 

But it has been 6 months now and there has no update or anything. 

 

Just recently we were able to talked with NBI office, but they are still looking for a Request Letter from the Embassy. Now its very confusing, cause the email from USE-Manila says they already requested  it and just waiting for NBI to reply.

 

Can anyone help us whats the best thing to do? Or share your experience if you been on the same situation before? THANK YOU

if he is spouse of USC ,  she needs to file CR1 I 130 

K1 is for fiancee  not spouse

Hi, thank you for your response. 

The filing was done and also the interview. All documents submitted with the petition was accepted. Now our issue is how to get the NBI explanation letter as part of the 221g administrative requirements? It has been 6 months now and there has no update at all. Thanks

You changed the wording from I 129 K1 to spouse

still if it was K1 ,  its the wrong form

Maybe you can get in touch with this VJ member.  From her post history, it seems her husband got his visa issued a couple of months after getting the 221g for NBI Explanation Letter --

Hi everyone im back, just some updates. We finally got the endorsement letter from USEM for the NBI Explanation Letter last April 13, 2021. My dad was interviewed the following and was told by NBI that they will forward the letter to USEM. Its been more than 1 month  and we haven't had any updates from USEM. But this week, it has been 4 consecutive days now that they updated the date but still it is REFUSED.  

 

Is this a good sign ? Will we expect something from the embassy soon ?
