Any Filipinos here that came here on k1 visa, married here in the US and now has a greencard and kept their MAIDEN NAME? I really want to know because I need to apply for Philippine passport RENEWAL soon and am not sure if i should declare that i am married and give them a report of marriage because I still want to keep my maiden name. I thought that report of marriage was OPTIONAL? Their form for renewal of philippine passport asks if I am married or not. I am married in the USA but not in the Philippines. Im just confused. HELP pls. Thankssss

You should declare in the renewal application form that you are married because that is the truth.  You are not required to change your name when you get married.  Philippine law allows married women to retain their maiden name.  (Refer to Article 370 of the Civil Code of the Philippines -- https://pcw.gov.ph/memorandum-circular-no-2016-07-allowing-married-women/)

 

I just renewed my passport a few weeks ago.  I declared that I'm married and kept my maiden name on my application form.  DFA was perfectly fine with it.  No questions asked, other than making sure that my name is spelled correctly.

That is not accurate.  Once you are married in the US, you are considered married in the Philippines, even if you do not file a Report of Marriage.  This is specified in Article 26 of the Family Code of the Philippines -- "All marriages solemnized outside the Philippines, in accordance with the laws in force in the country where they were solemnized, and valid there as such, shall also be valid in this country, except those prohibited under Articles 35 (1), (4), (5) and (6), 3637 and 38."

Yes, you can renew your passport under your maiden name WITHOUT having to do ROM. My wife did this back in 2018 without an issue.
