I am an engineer with a master's degree and a few years of experience all acquired while working with the same employer. I have asked my employer to sponsor my green card and after consulting with lawyers they decided to work on building a case for EB1-A even though I do not qualify for it yet. When I asked for the green card, I advised them to go for EB2, but I believe that may not be possible because I have acquired all my working experience and master's degree while working with them and that is likely to create issues during the PERM process.

As for EB1-A, currently I only have 2 granted patents where I am coauthor that are owned by my employer and several patent applications that have been filed but not adjudicated yet. My employer is looking to build my case by having me take part and present at podcasts, conferences, webinars and write some papers.

Is it correct that in my situation it would be hard to go for EB2 with my current employer? Would it be simpler if I changed jobs?

Is the plan of my employer appropriate to make me qualify for the EB1-A green card? How long can it take to build a case almost from scratch?
