Huhu. It’s bigamous marriage. They thought my moms annulment was finalized when my stepmom and dad got married.

Bigamy is an inadmissibility.  You can probably try get around it given the circumstances. I’d hire a competent immigration lawyer if I were you.

But, I am petitioning my father. It’s not like we are doing K-1 visa. You think still matters? I already asked an immigration lawyer and he said this things don’t matter for father daughter petitions. Only when he petition my stepmom. But I just want to know if someone has same situation with me.

Well first he needs to sort out the current mess and marry her.

I can see how you are primarily concerned with the petition for your father. But thinking long term and big picture, if your father eventually wants to petition his second wife (your stepmom), he needs to get the bigamy issue sorted now. It's probably going to take years.

Huh? An inadmissibility applies to any intending immigrant. That is why it is on the ds260 as a question (k1 do not fill in ds260 by the way). You can try get a waiver. Get another legal opinion.

him needing a legal marriage to apply for your stepmom is a separate issue.

If your father got the courts to presume your mother dead in 2000,  why did he need an annulment too. Wouldn't the presume dead certificate trump annulment?
