I-130 for Father while in process for his annulment

Hello, I would like to ask if we can file a petition for father even though he’s in process of annulment? 
And if he has complicated issue with multiple marriages, would that matter to my petition to him?

Huhu. It’s bigamous marriage. They thought my moms annulment was finalized when my stepmom and dad got married.

So your biological mom and biological dad's annulment wasn't finalized yet when your bio dad got married to his second wife?

 

If yes, that's unfortunate. Is the annulment of the first marriage finalized now?

Hello All,

 

I really appreciate your replies. I know my situation is really complicated. Unfortunately my my mom abandoned us (me, my brother and dad) when we were like 4-5 years old, so my dad doesn’t know where she was, I can’t blame my dad trying to move on and find another one. That’s why my dad file an annulment and got court order declaring presumed dead on 2000 for my mom. And on 2005 the judge/lawyer told him its ok to get married since annulment is just to be finalized, but not knowing my dad and step mom got married 2005 the annulment was finalized 2006. So there was an overlap. 
 

But yes my mom (first marriage) and dad got finalized and annulled 2006.

So I am not sure if this is going to be a problem if I petition my father? Since I only have to prove father daughter relationship right?

Yes, you are correct to both. It’s done 2006 the first marriage.

No, but I am not sure what other way we could bring her here. That’s why I am asking the facts now. Other than go through annulment again? Because my stepmom and dad still together with my minor siblings.

Hello, I am not sure why you keep asking that. But, just want to let you know, I can’t petition my step mom. So I have to start with my biological father, only he can petition my siblings. You seem to be very worried who will be left behind. I really appreciate your concern.
