Of course. I studied the USCIS criteria for expedites, concluded my situation matched the criteria, and explained it to the agent. The agent then confirmed via chat that they would file the expedite in the system. I saw the expedite request in my USCIS account the next day.

Hi @Adventine, did the agent ask you to submit evidence? Did you offer it? I have noticed that sometimes they do not ask for any and proceed with the request which may or may not be approved afterwards. A couple of people have asked me privately questions on how to expedite, and I just want to make sure I am steering them in the right direction. 

 

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

I wasn't asked for any evidence before the agent filed the expedite request for me. However, I had documented evidence prepared, in case the agent asked.

@Adventine That's great! Did they approve your request? How long did it take?

My EAD status still says "Expedite Received" but it may soon become moot, as I have my AOS interview on August 5 :) I have no idea if my EAD expedite request nudged my AOS interview to the front of the queue. At this rate, I may receive the green card before the EAD.

That's really interesting. Truth is we may never know if that did the trick! Doubt it, though. As far as I understand the process, the EAD/AP and Interview scheduling run on different production/factory lines. Your field office must be catching up OR it may be a system glitch. I recall that in 2018 USCIS was scheduling family based AOS interviews as employment based interviews within 90 days filing. It was crazy for a while. LOL

Yes, I agree that the EAD and green cards are two separate processing queues, but there have been a few reports on VJ over the years about people receiving the GC before EAD.

 

Whatever the reason was, I'm just glad it's happening much faster than I thought I would!

On or after June 9, 2021,[2] USCIS may expedite a benefit request if it falls under one or more of the following criteria or circumstance:

  • Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure: (1) to timely file the benefit request; or (2) to timely respond to any requests for additional evidence;[3]

 

 

My husband has a business that is highly impacted by the labor shortages reported in the national news. Business is actually going great but it is a struggle to find workers! I applied for the EAD expedite so that I could begin helping him.

Oh, when were your appointment for ? And what did they say in order to get your biometrics done earlier? I think I'm gonna try that too but I'd like to know what to say etc ?? Thank you so much!!

It depends on the ASC I guess. I tried to do that here in San Antonio and they wouldn't have any of it even though they weren't at all busy.
