Case FE Review note (income requirements)

Hello,

 

My SO is in the process of immigrating her mother. We received the following message:

 

"This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p."

 

My SO (the sponsor) does not earn enough money as she's in college. I am listed as a household member in the application process and my finances are submitted along with I-864A. Do i need to also submit an I-864??

 

Initially when we filed we tried adding me as a joint sponsor but that was denied and they said I needed to be added as a household member. So they've now accepted all the paperwork but are saying this about income requirements and to add an additional I-864. 

 

Is this just a typical message they send and the Consular officer will see my documents at the interview? I want to make sure we have all our things in order and this worries me.

again, my wife is sponsoring her mother. i am listed as a household member on the i-864a and my finances meet the minimum requirements for our household size and to bring her mom in. I’m contemplating submitting an additional i-864 on my part but maybe it isn’t needed?

 

Any guidance is greatly appreciated. thanks.

Can you share your household size as well as your total income in 1040, or gross income in 1040EZ?

 

Have you ever sponsored anybody else?

5 in the house 6 counting the intended immigrant.  i’d rather not state specific income level but my income is above the 125% threshold for 6 people per the latest guidelines. 

 

I DCF’d my spouse (who is now sponsoring her mom). Other than my wife, no I haven’t sponsored another immigrant/family member.

 

I ended up submitting a i864 yesterday as a joint sponsor. i just don’t understand because that’s what i did originally and they kicked it back and said i needed to be a household member. so we did all the paperwork as they requested, then submitted and now i’ve added myself as a joint sponsor (again) and submitted the i864 with me checking “i am the only joint sponsor”.  they’ve now approved me as a joint sponsor, so i guess it was the right choice. but they haven’t looked at the newly uploaded documents so i’m just guessing at this point.

Well the best advice is to just submit what they want lol. But in all seriousness the 864 forms can be filled out various ways for the scenario you briefly described. It can be primary sponsor (your wife) on the 864- listing her income (which is 0) and then her household members (you) and the 864a is attached. Or it can be primary sponsor on 864 and no household members and you on a second 864 as joint sponsor. Sometimes the numbers add up differently. Typically you can see the difference in cases where a parent is helping sponsor and they live with the adult child petitioner. For example- son wants to petition wife. Son is in college and has no income. Son can be household size 2 and do the 864 and have his mom fill out 2nd 864 as joint sponsor. Moms household size would be mom, dad, and underage sister + immigrant. So mom would need to meet requirements for 4. OR- son can send 864 and list mom as household member. The combined household size would then be 3. 

 

Im not sure if your numbers add up differently when you are used as a household member vs a joint sponsor 864 or not. The PI has always been a bit strict about the numbers (like for the 134 for the K which is a variation of the 864- they dont allow for cosponsors) so it could just be they want a joint 864 as a co sponsor filled out from you. It doesnt really matter because either way as a household member or joint sponsor your obligations are the same.
