Hi all, 

 

I filed my I-130 during September 2020 and it was approved Dec 8, 2020. On the 11th it was sent to the Department of State. They sent it to the NVC even though I am in USA (TX). I am currently on a student visa but when I filed I was on a work visa (TN) . I am wondering my next steps, I believe it would be the following if someone can confirm / point me in the right direction!

 

->File package I485/I765/I131/I944/I864 to Chicago 

-> Contact NVC to tell them I am in US and to send my paperwork to correct location

I just checked my PD and it's 9/23/2020 so does that mean I am good to file now? Also anything unique I need to do as they mistakenly sent it to the NVC

in your i-130 did you opt for consular processing or adjustment of status. if you said consular processing they would send it to NVC which would send it to the consulate in your home country.  who filled out the forms ?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Form I-944 no longer exists: https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/inadmissibility-on-public-charge-grounds-final-rule-litigation "As of March 9, 2021, applicants and petitioners should not provide information related solely to the Public Charge Final Rule. That means that applicants for adjustment of status should not provide the Form I-944, Declaration of Self-Sufficiency, or any evidence or documentation required on that form with their Form I-485."

You can do that if you want. USCIS should request the approved petition from them eventually.
