Not sure which NVC will apply: Montreal vs PK for LPR?

Hello, my fiance is a Canadian LPR and I'm filing for him from the US (i'm also an LPR).  As his country of origin is Pakistan, I am not sure to which NVC will apply- the one in Montreal and the one in Pakistan? Do we have a choice? Are wait times better for one than the other? Please any help would be appreciated!

Your first problem is that an LPR is ineligible to file for a fiancee.

NVC will send to the consulate of current residence.  If you want it to go to country of nationality, you will need to request this change.

The case will be send, at the NVC fase, to the US Consulate from the country your future husband is a resident. 

Unfortunately for Pakistani citizens the process time doesn't depend of the Consulate you choose. He will be in AP after his interview like all the others Pakistani and the waiting time can be days, weeks... even years.

Patience will be needed!!

Thanks for clarifying the terms there... what do you mean he will be AP though??

Pakistani cases have very long administrative processing because of the extensive background checks that the US DOS has to do on their own. Pakistan doesn't have a good database for background checks so the DOS has to do everything, and in this way will take all the time they needed. 

 

If you made a search here on the VJ about Pakistani citizens cases you will see that this time of "delay" is pretty common. 

 

Are you from Pakistan too?

Background checks can happen at any stage of the process, but the prolonged APs usually occur after the interview, yes.

Just want to clarify 

EVERYONE goes into AP for at least a brief period while a visa is actually being issued

as for being in "real" AP, it is true that it seems more likely for Pakis especially men, but not ALL Pakis or all Pak men go into AP, I would say the majority do not go into AP, and it is misinformation to imply that all Pakistanis go into AP

I never told that AP just apply for Pakistani people.

Her case was about a person from this country and that was my comment. 

Everyone that apply to a US visa will have to pass for the same steps, doesn't matter where we are from. Period!

Right, so exactly like I said everyone is in AP for at least a brief period while the visa is being issued

But your statement, that I quoted "He will be in AP after his interview like all the others Pakistani and the waiting time can be days, weeks... even years." implies that all Pakis will be in "real" AP, the AP that is actual checks and not just visa issuing which is incorrect and the statement I was looking to clarify
