Timeline

Hello , my USC wife filled her taxes for 2019 and 2020 and she got her W2's showed that she cant meet the minimum required annual income , but lately she get a new job and she reach over the minimum income , so we need to wait till the next year to get the new W2 or there is a way to show the new reached income and being my sponsor , Thanks

The instructions on the I-864 mention this:

 

Quote

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months.

You are misunderstanding the requirements.  Current annual income is the most important factor for determining sponsor qualification..  CURRENT annual income is calculated by current pay period gross income x number of pay periods in a year.   Past W2s reflect what was reported to the IRS....not what the sponsor CURRENTLY earns.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

she just filled in September of 2020,   so by the time of your interview (still a long way off) she will be able to produce a record showing this new job earnings

Thanks for your response , you think my interview will be next year ?

 

The US embassy will ask for the recent Tax return and W2 that already showed my wife didn't reach the minimum income and this way will lead us to wait to fill the new tax and get a new W2 showed the new income which it will be only on 2022 next year.

That is not how it works.  US embassy will need to know about CURRENT income, as proved by employment letter and/or paystubs.  If they have a concern, when they factor in that she did not meet requirements the previous years, they will tell you that you need a joint sponsor.

 

They do not tell you to wait until you get next year's tax return transcript.

As you can see in this embassy worksheet they're asking for the tax return and W2

Yes.  That is always required.  I-864 requires at least 1 year of tax returns, 3 years as an option.  It is just one of several routine documents you need to provide.

 

Their decision is based on CURRENT income.. Previous year's tax return is evidence of having stable income.  When things change, like a promotion or a new job, paystubs and employment letter can suffice as evidence of current income.

 

I would cross out any personal information on any documents you upload here on VJ.. This is an open forum visible to anyone.who wants to see/read.

I don't see any of the documents checked on that list. How do you know that is what they are asking for? Regardless, read the posts by @SteveInBostonI130, as they are correct.

 

Please cross out the name on that image you posted.

 

Also, please update your timeline as that will help people to know how to answer your questions. You are showing us a document that came from the US Embassy (and that is usually issued after the interview), but according to your timeline the I-130 has not been approved by USCIS yet.

Ok then you think that my wife don't need to use a joint sponsor and go ahead to submit her Tax transcript of 2020/2019 and old w2s , letter from her employer with the new projected earning and some pay stubs ?

What makes you think they are asking for anything?  The form you posted only says your case is in administrative processing.
