Right.  And with the April 12 announcement of shifting away from ROC interview for all who went through consulates, that will free up resources to focus on cases that have actual red flags for marriage fraud.

Perhaps you can read VJ members @Libertatedetailed post today ( including contact info) regarding AIC ( American Immigration Council) offering FREE legal representation and upcoming class action lawsuit for USCIS delays. It’s at least worth the effort to reach out to AIC . I know @Crazy Cat has surely lost his patience w USCIS delays &  can perhaps direct others to @Libertate amazing post. Who knows, a ripple, a wave , a tsunami..

It was the fashion police dept. of DHS,  checking underwear crimes against fashion at 7am.

 

 

Honestly, I would be very caught off guard and peeved by this whole thing.

What purpose does a home visit serve, if a) it was originally filed with a divorce waiver, not switched to one, and b) they have already had an interview a year ago? And remember that this is for an I-751...not an initial I-485 adjustment.

 

I have no idea what a DHS badge looks like, let alone how to verify it like you could with the cops ('yeah....please wait there while I phone USCIS to verify you are legit....it shouldn't be long, a tier 2 will call me back in 30 days') and I would do the exact same due diligence required with anyone claiming to be in a position of authority, be it police, DHS or whatever, before saying anything to anyone. This isn't an airport or USCIS building where one would expect to encounter such agents and they have the right to search/question etc on their turf, this is your own damn home.

I certainly wouldn't be standing on the doorstep in my calvins chatting, and I wouldn't be inviting anyone in (based on awful personal law enforcement experiences in the past).

If they asked to come in, I wouldn't be letting anyone in without some sort of warrant, as it sounds like fishing exercise, but with no legitimate purpose, given the OP has been truthful about them not living together and has not claimed anything to the the contrary. They aren't verifying that the OP lives with a spouse, which would be the normal and understandable circumstances for a surprise home visit for, say, an I-485 when adjusting from the VWP or whatever. You cannot be too careful nowadays, both with personal safety and with identity theft (they took a photo of your ID? they are the Government, so should already know or be able to access it....right?).

Even a surprise visit when filed jointly and claming to live with someone is also more understandable...but this? And for an I-751? No way pedro. 

I suspect if this was to happen, after my own experiences, my response would be something along the lines of 'please schedule another interview' /'please schedule a visit by official USCIS mail' / 'please speak to my lawyer' / 'come back with a warrant'/ 'kindly **** off' depending on my mood at 7am on the day in question...but then do understand that that is after seven years of being royally shafted by USCIS and this whole I-751 farce, so my reaction may be stronger than others...

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I wonder if OP’s ex-spouse got in trouble and that’s why they were questioning him about their past. Or maybe she is trying to get the OP in trouble. You never know with these exes!

If USCIS says the DMV says the ex has other addresses, I would not discount it and I would doing a simple investigation.
 

Suffice to say that when you enter a person’s name in a web search engine, certain websites (that Visajourney management has warned me to not name) produce all manner of accurate details for free.

I was actually curious myself and did a little googling after all that happened yesterday and it looks like my ex is actually doing very well and has moved out of town.

I am aware that my ex moved around a few times due to school and jobs BUT that was prior to us living together from 2010 to 2018 in the place I currently still live in.  So there shouldn't be any other addresses reflecting during that time frame.

In the UK there are strict data protection laws…but not so in the US, where with google you can find out absolutely anything about someone, and their links to others. It was an eye opener. 
I’ve been so super careful with what info I put out - or more accurately don’t put out - and even my name, info, and address appeared in a few of those searches on websites in the past, and I have no idea where they have got the info from either.  You can get them removed but it can be a hassle with some of them.

That’s what I was thinking. If they’re divorced, most likely they’re not living together anymore. 
I think this visit was a mistake. I think Joe and Jack (assuming those were the agents’ names) were like “well we have some free time in between now and the time Bob Evans opens for breakfast) 

This is how I imagine their dialogue 

Hey Joe, Christi from USCIS the other day. She said she has an application that is sitting on their desk for about a year and a half. It’s collected so much dust she can’t really tell it’s a 485 or a 751. But she asked me to buy her some time and go do a home visit in case it’s a 485. Wanna go with me?

 

Joe looks at the clock. It’s 5:45 am and Bob Evans opens at 7:00. Sure, why not? There’s a Bob Evans nearby. Let’s go.

So an update... Today I received a letter to attend an "INTIAL INTERVIEW" for my I-751 application... I've had an initial interview back in April of 2021... Now they want me to come back for another " INITIAL INTERVIEW" in August. At first I thought it was for a second interview but it says specifically says "initial interview". It looks exactly like my interview notice from 2021 except of course this one is dated July 1, 2022 and is scheduled for August 5, 2022. Anyone ever heard of this happening? I'm going to call in tomorrow to see what's going on. I also have an N-400 interview on August 4, 2022 so I don't understand why they can't just do it on the same day if they really want to do a second I-751 interview.

I would definitely call in and request to speak to a second tier.  Please keep us posted.  Sorry you are going through this.  Did you ever apply for citizenship?
