Hi,

I'm USC and I've a son under 18 who was born outside the US and still living with his mother in one of the EU countries. We divorced in 2006, he would like to come and live with me.

What is the difference between submitting I-130 or N-600? Do I need to submit both?

Did you not obtain a CRBA from the US embassy when he was born?

Are you eligible to pass on your US citizenship to him?

How does his mother feel about him coming to live with you?   What is the custody arrangement?

You can’t file both. He either needs a 130 for an immigrant visa, or he can get a passport/n600 to prove citizenship.  Did you meet the requirements to pass on citizenship to him? If yes, file a CRBA with the embassy and get him a US passport. If no, you will need to file an i130 for him.
