Hi, 

 

My I-130 case was supposadley transferred from TSC to VSC in February 2021. This is exactly when we should have received an approval or denial from TSC. We filed June 2020.

It is a "difficult Case" having been denied the first go around in 2010. Not sure if this is why it was transferred and on top of everything else their wait time is horrendous, two years when we have already been waiting through the TSC for close to ten months.

 

What have others experienced with their case being transferred to VSC, was your case a "difficult" case? Do we start from scratch counting the wait time?

Why was it originally denied?

 

Vermont often processes k-1/129f  cases in which the  petitioner has a criminal record.  I’m not sure if it is the same for the IR/CR petitions, or if it is more of a workload balance.

Hmm interesting. Yes it was originally denied in 2010 because they thought there was criminal activity, they gave my spouse a life ban. We are definitely aware that there is a 50/50 chance this go around, but we were willing to risk it and we have a lawyer that specializes in these types of cases. The lawyer made it very clear to us that there is a 50/50 chance on getting approval with the I-130 this go around.  This is very interesting, I hope more people respond to this thread to compare. Thank you for your input.

One more question, do you think or know if the VSC wait time is accurate on the USCIS website? Do they do a pretty good job on updating the wait times?

Wait times fluctuate on a grand scale.  Always have.  I'd just keep an eye on it and see how much it changes over a period of time.

 

As to accuracy, I am really not sure.  In my own case, the wait time for petition approval, EAD/AP and AOS were at, or just under, the official published processing times.   This was also pre-COVID though.

Our case was apparently transferred from Nebraska to Vermont.  We are about as easy as it gets:  American citizen married to a Canadian citizen with a dual citizen child, currently residing in Canada.  Married over 6 years, no criminal records whatsoever.  

 

I really hope the processing times are incredibly inaccurate.  I can't get over going from a center that is 2.5-7 months, to a center that is 24-35 months.

So my lawyer submitted an inquiry and they came back and said that it was within processing times.   I told my lawyer that I heard that difficult and complicated cases get sent up to Vermint, they responded and said that isn't really true all the I130 is verifying the marriage.  So they are submitting another inquiry and asking why the case was moved up to Vermont, I will update here.

Whats really odd, I've been following the Date of Inquiry date on USCIS Processing Times for Vermont and last month in June 1st the Date showed 3/17/2018 on June 9th it showed 3/25/2018 yesterday June 30th it showed 3/06/2018, what kind of ####### is that?
