I751 interview done with no decision

A couple of days ago was my I751 interview and jointly I was supposed to have my n400 interview. When we went there with my husband a guy came out to us and asked to see the letters and my husband passport. And stated that someone is going to be with us (he didn't do this with anyone else). 1 hour later a officer came out and started yelling at us: "aren't you supposed to live separate". We was very surprised from her reaction we went in the office with her she ask me to wait outside after this she did the same with my husband. She asked literally 4 questions about my case and the same my husband on which we answered wrong on one, because on Monday I was working on 2 jobs and my husband told on 1. She told me that she is not able to decide on my case and is declining the n400 interview. We didn't have a lawyer with us, because we wasn't seeing a reason for one. We are married from 5 years and know each other from 9 years. We register our marriage in my country too. Is there anyone with case like this? How long is going to take this time for them to decide?

What country are you from? Do you have a big age gap?

Since they ask some questions like that, pretty sure they have found something. I think you 're the only person know exactly what go wrong.

That's an odd thing for the IO to start with. Is there anything in your evidence that would make her think you weren't living together?

That does seem like a major detail that an IO would expect you both to get right.

Assuming the IO's "live separate" question was a test, and assuming the IO and her supervisor don't consider the inconsistent answer a big deal, I'd expect a positive decision in under 30 days. Otherwise an RFE or worse. Might not be a bad idea to consider an immigration lawyer.

 

One thing a competent immigration lawyer would have coached you on is the importance of having consistent answers, and where a spouse works is one of things you'd be coached on and told to practice. And also if there was anything in your evidence that suggested living separately a lawyer would have advised you to clean that up too. Of course such advice is on VJ too.

I don't know I was totally confused from this decision. The officer mood was horrible and she was keep cursing on Spanish (I speak the language) before she started the interview she spoke with someone else there and she was fighting with this person. Every time when I answered the question she was making faces. She ask me for my paystubs for 6 months back, but I didn't have them, because there was no request like this in the letter

If she asked for paystubs after the inconsistent answer on your employment, that is why.

The problem with my second job is that my schedule is different every week. There is no away to know it before the initial week. And my husband is not with the greatest memory.

Perhaps your husband or you misunderstood the question. If the question was about your specific schedule and how many jobs you were working on a particular Monday, I agree that most spouses wouldn't be tracking that. If you have a second job, and then perhaps the question was intended to be about your second job. Regardless, a more complete answer from your husband would be: "Nagisa33 has different schedule each week, and I don't remember what job or jobs she was working that day. I do not that she has worked for hours for ABC and DEF in recent weeks"

Do your jobs require you to spend the night away from the home you share with your husband?

As others have pointed out, experiences like this do not stem from legitimate, well-prepared cases.

 

It does not sound like merely a situation of that USCIS officer having a bad day, either.

 

There is something about your case that they are questioning.   Have they ever shown up at your home?

There are plenty of posts about appalling attitudes and treatment by interviewing officers only to be subsequently approved. They aren't renowned for being the most polite

 

 

You usually get a decision within 30 days or so

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.
