EAD timelines

Hello everyone, my fiancé is moving to the US with his K1 visa in May and we plan on applying for AOS ASAP.

I realize that the timelines are crazy because of Covid but I had a question about EAD timelines. I noticed that there are some EADs that get processed within 5-6 or even 4 months while there are some that take as long as 9-10 months. What’s the reason behind the discrepancy? Is this difference based on how busy your local field office is? Or is it just pure luck? I guess I’m not really understanding how involved your local field office is with the EAD/AP/green card process compared to the National Benefits Office.

thank you!

Some people are able to expedite the I-765.  That might be one factor.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

EADs are processed at NBC, they don't depend on the local field office. Think of USCIS officers as cashiers in a supermarket. The line with customers with more stuff in their carts will take longer  than other lines. If you get a cashier that a little bit slower, even if you have a small basket, it also might take longer.

RFEs also affect the EAD/AP timelines.

Thank you! Brings me to another question then. I’ve noticed that the processing time varies and could be from 4-11.5 months according to the USCIS processing times website. Is there any reason why even without expedite some peoples’ takes only 4 months while for others it might take 11.5 months?

The explanation is in the message you quoted.
