IR1 Visa questions

Timeline

Hi,

 

I am a US citizen, living in the UK.

 

I am looking to bring my husband (UK citizen) and daughter (UK citizen) to the US under an IR1 visa.

 

I have some questions around this which I am hoping to receive some advice on.

 

1) I-130: I know I need to submit this for my husband but does my daughter need a separate one (please note that she will have a US passport and I have applied for the CBRA with the embassy)?

 

2) Once our visa is approved do I need to travel with my husband as his sponsor or can he arrive at a later date / separately?

 

3) How does health insurance work if, for example, we move to the US without either of us having jobs lined up prior to moving?

 

4) Timelines: From having a brief look at the timelines posted currently, it seems to be about 12-15months. Is this relatively accurate for current applications?

Timeline

She is the same as you and just needs her US Passport

 

He can follow, often the USC has to go ahead to be able to sponsor show domicile.

 

You can buy cover.

 

Probably longer, difficult to tell due to Covid.

A US citizen doesn't need a petition to come home.

Timeline

1.  US citizens need only a US passport.

2.  You, the US citizen, must arrive before or with your husband for the initial entry.  He can follow alone later.

3.  There is a wide range of private insurance plans available.

4.  Pre-Covid, the average was 12-18 months.  Per Capt Ewok, the VJ Guru, this is the latest as reported by other VJ members which  depends on how many members enter their data. You time could be longer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Can I just confirm a point...my daughter was born in the UK and, as i mentioned, I have applied for a US passport for her but the embassy appointment has twice been cancelled because of Covid. I thought I read somewhere that a separate I-130 needed to be filed for her but on entry she would automatically become a US citizen as she is also under 18.

 

I just wanted to double check whether an I-130 is required for my daughter or whether obtaining the US passport is sufficient?

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
