Hi all! I am about to be eligible to file for ROC and was a bit worried since we live in a house I bought before marriage so my spouse’s name is not on the mortgage. These are the evidence we have showing bona fide marriage: 

1. utilities bills showing both our names (only 2 months of electricity bill since we just recently called them to update our bill to show both names, water and gas bill are impossible to add both our names but we have them in either my name or spouse’s)

2. IRS mail about stimulus check addressed to both our names 

3. Actual copies of credit cards 

4. credit card statements showing both our names 

5. Health, dental and life insurance showing my spouse as a beneficiary 

6. car insurance showing both our names 

7. Joint tax returns for 2019 and 2020 

8. Vacation to Disney together (flight tickets in our names) 

9. family photos with my mother in law 

10. Receipt showing spouse’s gift purchased for me 

 

Are my evidence considered strong enough? Would the utilities bills be sufficient? Would we need affidavits from our friends and family to prove our case?

You can only send what you have. Our home is only in my name (purchased before marriage).

 

Do you have joint bank statements?

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

Like Debiedoo said, BANK STATEMENTS! they like to see the money comingled in one account. I did a quitclaim deed and put my spouse on the deed of the house. More of estate planning than anything else as we are both in our mid to late 60s. Good Luck

Don't worry about your spouse not being on the deed or mortgage.  Just add a short paragraph to your cover letter explaining that you purchased the house before you married.  Then make sure you have evidence to show that you both live there - for example, copies of both of your driver's licenses or voter registration showing your address.

 

You'll be fine!  I owned my house free and clear before I got married.  I just explained that in our cover letter, and had copies of our licenses and voter registration.  We had absolutely no issues.

We don’t have joint bank accounts due to our different investment strategies, but we have joint credit cards. Would that be sufficient?

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

It's also ok to have separate bank accounts, but it's not the usual thing that couples do.  Be sure you explain (in your cover letter) that you don't have joint accounts because you handle your money separately - but you'll need to show how you pay your bills.  Or at least describe how you pay your bills.

 

Joint credit accounts are good.  How do you pay them off? 

 

Also, you don't mention it, but even if you own the house/have the mortgage, your homeowner's insurance should list BOTH names as claimants.  This means if one of you should die, the other spouse has the ability to file an insurance claim.  It's not just from a USCIS perspective that this is important - but for life in general.  A classic example - your house has a tree fall on it, and it kills one of the occupants.  The other occupant needs to be authorized to file a claim to repair the house.

 

In your case, it would strengthen your case to have wills - especially showing the homeowner is willing the property to the non-home-owner.

 

I think you will be ok - you just need to think like a case officer...how does the paperwork you submit show these two people live together, do life together, and are planning for a future together?
