I-864: personal vs. company assets

Petitioner. Self-employed, own a small business registered in the U.S. Will continue business after immigration.

 

If I'm using assets on my I-864, does my business assets count? Like, can I include cash in a business checking account on my I-864?

Is your business a sole proprietorship?  Is the account in your name?  Is there a business entity?  Can you transfer the money in the business checking account into your personal account?

You can use assets that is in your name.  You can not use assets that are in a company's name.

Since the business is continuing after you leave VN, then you can use the income to sponsor.

Not a sole prop, but an entity (LLC). Account is in my business's name. I can transfer to my personal account, but the proper way to do it is through payroll. 

 

I asked because it's my preference to be the sole sponsor, but I'm thinking it's probably easiest and least complicated to just get a joint sponsor lined up anyway (which I do, my mom agreed to it).
