Hello Guys,  I just want to seek your advise regarding on my question if it’s possible to have a interview for immigrant Visa in the United States instead while waiting for the interview schedule here in the Philippines. I already DQ last October 2020 and I have my tourist visa and i am thinking if it’s possible to do that I will have to pay my visa and maybe the process would be faster?. since we are on lockdown and it may take a while to get that schedule and plus the backlogs. I’m just thinking if it would be the best options. Thank you so much for reading my post.

You cannot have a visa interview in the USA.  
 

You can file for adjustment of status if already in the USA.  You will need to inform USCIS and NVC that you wish to cancel consular processing.  
 

If you are not in the USA, then this option is not available to you.

1. You cannot use a tourist visa to enter the US with intent to immigrate 

2. What is your case type and priority date? Being DQ’d isn’t enough to get you an interview date. If your priority date is not current you cannot file adjustment of status anyway.

3. If you wanted to get a green card in the US, you cannot do a “visa interview”, you would have to do adjustment of status. Your priority date would need to be current. At this stage being DQ at NVC becomes totally irrelevant. You would have to file an i485 in the US, pay the fees and...wait, probably a year, quite possibly longer, to get an interview. In the interim you would be unable to work without an EAD or travel internationally without AP; these two have been taking at least 6-8 months lately.

 

There is almost no instance (now that the bans have lifted) where doing AOS makes sense if you are already DQ’d as it is almost certain to take longer.  And if your priority date isn’t current AOS isn’t even an option.

Hi Susie thank you so much for reading my post I just want enlightenment on something that I don’t regret in the end and could possibly ruin everything. My PD Nov2010 / DQ October 2020 / F2B.

Regardless, you cannot enter the US on a tourist visa with the intent of adjusting status.  That is FRAUD.

You need to be patience and wait for your visa interview in Manila.  

There are no visa interviews in the US.  Visa interviews happens outside the US.

 

It's visa fraud to enter the US on a tourist visa with the intent to immigrate by adjusting status.

 

You're close, so be patience.  Don't do anything that will jeopardize your chance to immigrate to the US.

Welcome to the waiting line my husband also has DQ Oct 2020 and in Colombia they go in Cases with DQ April and May 2020.  It only remains to be patient.Good luck

Oh how did you know which month they are currently processing? is this base on the Visa Bulletin? Thank you

We have a private group on Facebook of CR1 / IR1 cases pending appointment for interviews and they are in Colombia at that time.  I don't know how they go in your country.
