Do we need to renew EAD for someone who has a green card?

Timeline

My wife has a green card which expires in September 2021, so we’ll be filing her Removal of Conditions (I-751) paperwork in June.  However, her EAD/AP combo card expires in May.  

 

My understanding was that once we have the green card, we don’t need to do anything else to keep EAD/AP going except for Removal of Conditions.  But I’ve seen a few threads here where other K-1 visa holders are discussing renewing the combo card.  Do we need to do this, given that she has a green card already?

 

If so:

 

  1. Can she still work while the EAD/AP renewal is pending?
  2. I had read in another thread that there could be a 180-day extension.  But my wife is a teacher, and her school year follows a typical U.S. school year.  So an EAD that expires in November would be expiring during the school year.  How can we make sure that she’s ok to work through the rest of the year?
  3. Is there anything that we or her employer can do to expedite the renewal?

 

Also, thinking ahead to I-751: her green card will probably expire while we are waiting for this to process.  As long as we have filed that form, is she still able to work?

June 2016: We started writing to each other

June-July 2017: Met in person in the US for our first anniversary

December 2017 - January 2018: Met again in the US and got engaged

01/09/2018: I-129F sent to the USCIS Dallas Lockbox via FedEx

01/16/2018: Received NOA1 (NOA1 notice date: 01/11/2018)

June-July 2018: Met in person in Singapore and Australia for our second anniversary

08/03/2018: Notice date on our NOA2 (updated in USCIS's new website on August 6)

08/15/2018: Our case reached NVC

08/22/2018: Received NVC case number

09/04/2018: Our package left NVC (arrived 9/11, and she sent packet 3 that day)

09/20/2018: Received packet 4; scheduled interview

10/30/2018: Interview - told that we're approved!  Now waiting to receive the visa...
11/27/2018: Port of Entry at BWI

12/1/2018: Our wedding!

12/8/2018: Filed AoS on the way to our honeymoon (12/8-15/2018)
6/~7/2019: EAD and AP approved
09/25/2019: AOS interview in Orlando -- approval and green card!

Next step, June 2019: Filing I-751

 

Note: My wife is a Singaporean.  She moved to Australia before we met and got permanent residency there.

Timeline

There is no EAD renewal for a Green Card holders.  Green Card holders do not require EADs.  Any EAD she had received prior to receiving her green card was voided when her Green Card was issued.   The Green Card, itself, is authorization to work.   She can continue to work after filing for removal of conditions.  Her status as a legal resident and her authorization to work do not expire when the green card does.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Those are people who have received EADs prior to receiving Green Cards....but who have not yet received their Green Cards.  Sometimes, initial EADs expire prior to Adjustment of Status interviews.  Your wife no longer requires an EAD since her Green Card was issued.

Her EAD became invalid the moment her AOS was approved.

She can continue to work.  
 

Some existing employers will illegally try to reverify her once her 2 year gc is within 90 days of expiration.  
 

For I-9 verification with a new employer, photo ID and an SS card without the words saying it isn’t good for employment are sufficient.  Otherwise her expired green card plus the I-751 extension letter are enough for I-9.
