I have been waiting for almost 7 years for i751 approval

I understand the situation is unique but USCIS not saying yes or no from an interview in 2017 is also not normal?! Then another interview 4 years later?

 

Lots of focus on the OP but this delay is kinda relevant too. 7 years of no answers? Doesn't matter if their together or not, USCIS should have an answer or an RFE. Something!

Jan 22, 2024 - Submitted online 

Jan 22, 2024 - Biometrics waived

Mar 6, 2024 - Interview scheduled for Apr 11 COMBO I-751/N-400

Apr 11, 2024 - Combo interview - approved N-400

May 1, 2024 - Approved ROC, received 10 GC on May 20.

May 7, 2024 - Oath scheduled for June 14 (requested later ceremony at interview)

June 14, 2024 - Special Flag Day Oath ceremony - I'm a citizen!!!

Amazingly they can do this.

It is (well!) outside the generally accepted timescales for response, but it is permissible for them to do this. There are all sorts of get out clauses meaning they can basically do what they want, even if it contradicts their own policy and AFM. 

Add in an investigation, and yeah....

As I oft post, they are largely accountable to no-one

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

true but its the government. unless you take them to court, not much is going to happen if they are not making a decision.

This is interesting. You should have inquired about why it was taking so long a while ago. Why did you wait so long to ask? I would have been contacting ombudsman by now. Skipping the interview is a huge deal too.

I think my case has been delayed because there is an age gap between my husband and myself (16 years). My husband is also of a different ethnicity. It is the 2nd marriage for my husband, the first for me. 

 Writ of Mandamus can be filed by yourself if you are familiar with immigration law and court procedures. If not, find a lawyer. You can start by googling Writ of Mandamus  law firm in your area. Call a couple of them and explain your situation and they will let you know if your case qualifies. i dont see why but your case is more complicated than getting an adjudication from USCIS.  Adjudication in your case will become final when WOM is filed.  If USCIS decides to deny your case than you will go directly to removal situation.

You can either live with your husband, file a change of address, and wait for interview, or get a divorce

I think you can avoid an immigration attorney provided you stop ignoring USCIS instructions.

 

After ignoring USCIS enough times,  you will go into removal proceedings, and at that point you will need a lawyer.

Don't expect an instant decision even if you have a final divorce decree.

Whether it is 4-5 years or not cannot be helped.

 

In summary your choices are:

 

* Continue with the joint I-751 filing which means living with your husband to establish a bonafide relationship. A joint filing where your husband attends, yet doesn't live with you has a low likelihood of approval.

 

* Convert to an individual I-751 filing which means divorcing your husband.

Are you sure you are not in removal proceedings?  You need an attorney, not VJ.....good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There’s definitely something missing here, either because OP doesn’t know, or doesn’t want to tell IMHO. Something doesn’t add up, for sure.

I am not in removal proceedings yet. It has been 6.5 years since I filed my i751. Do you know how I can request the Zoom call? My husband and I no longer live together because our circumstances have changed. He is taking care of a sick relative in another State and I stayed behind to continue working and earn income. Doesnt USCIS recognize that some couples will move apart? Especially after so many years. We lived together for 8 years before he moved.

Yes they do. Thats not the problem here. Why dont you start with your first I751 interview. What evidence did you submit, what was said during the interview. No one here can give you an ounce of advise till you tell the whole story. USCIS may be a lot of things but going this long without a decision signals major issues with your case. come clean, tell the whole story.

My first i751 interview in October 2015 went well. The Officer said we would be approved. I submitted joint tax returns, joint lease, joint bank accounts, joint health insurance forms. They never asked for an RFE. My only concern is that the Officer thought it was fraud based on my country of origin(ghana) or the demographic differences between my husband and myself. There have been alot of fraud cases with Ghanaians. It has been almost 6 years, i dont remember every single detail of the interview. Why didnt they just deny me if they had concerns? 7 year wait is really not fair, especially if they plan to deny me anyway.
