ACTUALLY JUST DID THE CALCULATIONS AGAIN AND I OVERSTAYED BY 363 DAYS!!!SOOOOO WHAT U THINK???
HI-- THANKS FOR YOUR POST--

I ENTERED THE STATES ON 7 NOV 2002 AND LEFT IT ON 3 FEB 2004 SO THAT GIVES ME 426 DAYS IN TOTAL IN THE COUNTRY. SO IF I TAKE THE 90 DAY AUTOMATIC ENRTY VISA AWAY FROM THAT I GET 336 DAYS THAT I OVERSTAYED MY VISA BY. I HAVE NOT ATTEMPTED TO ENTER THE COUNTRY SINCE THAT DATE-- SO IF I CAN FIND ALL THE RELEVENT DOCUMENTATION TO SUPPORT THIS I SHOULD BE OK RIGHT???? :(

A waiver will be needed.

Not if they can show the overstay was less than 1 year. It has already been more than 3 years since they left.

It was less than 1 year. If you can prove it to the consulate's satisfaction, you should not require a waiver.

05/02/2007 Driver's License - Passed Road Test!

05/27/2008 Lifting of Conditions sent (TSC > VSC)

06/03/2008 Check Cleared

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail
