I-751 APRIL 2021 Filers (Removal of Conditions)

Hello everyone,

USCIS received my papers on 04/05/21

NOA date is 04/23/21

I got  I797 today 04/30/21

My case is in California Service Center

I have 2 questions:

1) Any idea when can I expect the invitation for biometrics processing? I want to go to my country of origin to solve some time sensitive issues with papers and the earlier I go there the better. I might need to spend there 3-4 months.

2) Also not urgent question but it would be good to know: what does one do if his/her 18 month extension expires before he/she gets the second Green Card? Extension of Cond. resident status is valid for 18 months but processing times in California are 20-24 months.

Thank you!

1) Biometrics will very likely be waived if they were taken during the previous stage -AOS-.

2) A little before the extension letter expires, you should schedule an info pass appointment at your USCIS local office to get an I-551 stamp on your passport.

Depends on your service center. Go to the April filers spreadsheet by clicking this link and on the second sheet you will see links to spreadsheets from previous months. You might find some info on CSC and other centers on when biometric letter was sent.

Thank you. Biometrics were taken during previous stage but I paid for it together with I751 fee because USCIS calculator showed that I had to pay it...do you think they will waive it in this situation and return money? It is not a matter of money I paid for biometrics, it is a matter of temporary leaving the US and being sure I will not need to rush back

As to second question - thank you! That is crazy!

Lol it's the government my friend, your (and ours) money isn't coming back 🤣 As for waiving, yes, that seems to be the trend so far so pretty safe to say that it will be waived for us too.

Even if they're waived, the money is not returned.

If you check posts around the forum, the great majority gets the biometrics waived.

Well, once I sent check to USCIS by mistake (I thought I needed to pay for the form but I did not need) and they sent the check back to me saying I made a mistake 😎

That’s good! I hope it will happen exactly as you are saying (fingers crossed!). Will I get any notification that biometrics have been waived?

Why would they return the money? The biometrics fee covers not only the action to capture the information, it also covers the cost to run background checks. If they wave the biometrics appointment and re use your existing biometrics information, they still need to run a background checks on that. It cost money to do that, and the fee covers that.

Thank you. Once USCIS returned my check sent with another form by mistake. I did not need to pay for that form but I did not know that and sent the check. Money is NOT my concern in this situation.

Got it on 4/22

But no notice yet and check not cashed. My husband is afraid we did something wrong and they won't mail it back to the right address as our physical and mailing address isn't the same.

How long does it take to cash the check?

No need to worry, things are moving at a slower pace at USCIS. It typically takes 3-5 weeks these days for NOA1. You can enter your info here and see where others are at on this spreadsheet.

Received the piece of paper of proof on 04/19/2021, the signed was a stamp from the USCIS lockbox.

Charge pending  04/29/2021
Text and Email with Case Number on 04/30/2021
Green card expired on 04/26/2021, we were late on sending off from a mixture of waiting for printer toner to arrive which took 2 weeks and hubs was on a business trip for 1.5 months. But we sent if off before the 2 year mark.

We didn't submit photos of ourselves but what ever things we were able to do before covid hit. We also didn't block out anything in out bank statements, but I explained how we used each account and how come we have money being xfered to Russia. (hopefully this doesn't bit us in the butt, but its to pay for his kids child support)
