I am filing concurrently for my mom. And I am trying to figure out what it means in the I-131 instructions when it is asking for an evidence showing circumstances that warrant AP?

Also, for the copy of document showing present status, is it I-94 even though it is expired?

I-94 is a CBP document, not USCIS.

 

You will need the USCIS receipt number for the I-485 and I-130.  If you are submitting it all at the same time, then no additional document is needed for that section.

I was thinking I will at least need the item (1) because of the word "and" at the end of that sentence line?

Item (1) states "if any".  If you have any USCIS document, then attach it.

At least a copy of the I-94 for the I-131 filing even if all the forms are filed concurrently. Last year USCIS *wrongly denied an I-131 I filed because of:

  • Are not in immigration proceedings or under an order of deportation, removal, or exclusion.

Statement of Facts and Analysis, Including Reason(s) for Denial


To be considered for an advance parole document (APD), you must establish that you are applying for lawful permanent resident (LPR) status and that you are eligible for this status under section 245 (a) or (i) of the INA.
 

We do not have sufficient evidence that an immigration officer admitted you in any particular status or paroled you into the United States. Because you have not established that you were admitted or paroled when you last entered the United States, USCIS will not issue you an APD.
 

Therefore, we have denied your Form I-131. This decision has no effect on future applications you may file with USCIS.

 

*Since it was wrongly denied I quickly contacted the CIS Ombudsman and the denial was changed to approval right after the Ombudsman contacted them on my behalf: "I have received action or decision that involves clear errors of fact or misapplication of law by USCIS."
