Getting married with B1 visa or wait for k1

Hi! 

I know this might not sit well with some but here we go. 

We currently have a K1 visa application wating at NVC (NOA2 April 9, 2020) due to COVID everything came to an end and we're on hold now. 

Back in November I (the petitoner ) got COVID aand my fiancee came to take care of me, she stayed for the holidays and right after the holidays I had an ultrasound that showed a tumor. 

I had surgery last week and had the biopsy done (currently waiting results) but now we both dont want to be seperated and are seriously consiering doing AOS and forgetting our K1. 

Her six month permit ends in May, any suggestions on how to start or if we should wait?

Nothing wrong with your plan if both are currently inside the US.

1.  Step one:  Marry.  Once you marry, the K-1 is voided.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

N400 Filed:  2018-01-13

N400 Biometrics:  2018-02-22

N400 Interview:  2018-04-10

N400 Approved:  2018-04-10

Oath Ceremony:  2018-06-11 - DONE!!!!!!!

we applied k1 at 2020.8 ,then i used the B visa went to US (via Mexico).Then we get married here this month.I got NOA2 of the k1 visa few days ago...

So we withdraw the K1 visa and filed the I 130.

i will leave US next month waiting for my CR1 visa.

1/17 Got USCIS IOE#.Case was received and a receipt notice was sent.

1/23 Check cashed

1/26 Case Tracker update :Biometrics appointment was scheduled.

2/2 Received Bio appointment in mail and rescheduled the bio appointment online

2/6 Received  NOA and extension letter in mail

2/7 Done Bio in person and status changed to "Actively reviewed"

Have you considered staying in the US and adjusting status for a green card?

totally no...i wanna go back to my hometown waiting for the CR1 VISA.

stay here is not the best choice for me

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

We got results back and its not a malignant tumor. 

Regardless, we were scared . I sent a expedite request about a week ago, hopefully we get approved. If not we're still considering getting married, its hard to go through something scary like that without your significant other.
