Case went from approved to RFE or NOI

My approved k1 visa petition was sent back by the NVC to USCIS, now USCIS is claiming they need more evidence and issued a RFE or NOI, what does this mean and has this happened before?

It sounds like NVC found an error.  I would send them exactly what they want.  It is rare, but it happens.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How long does this process take and the request is for additional evidence, what would additional evidence be? Everything was summitted  as per the petition instructions.

Depends on what they found wrong.  Did you include proof of meeting within 2 years and signed letters of intent from both people?

I sent in all required evidence, I94, pictures, everything that they wanted. A agent at uscis approved the petition the first time, they had to have checked to ensure everything was received.

USCIS makes mistakes sometimes.  It could be their mistake instead of yours.  You'll just have to wait.    Are you the petitioner?

RFAE = Request For Additional Evidence.

 

It sounds like the NVC is requesting additional evidence which isn't the same as "initial" evidence.  Initial evidence is simply the required documents/evidence required in the initial filing. 

 

Additional evidence is evidence that isnt required in the initial filing..   Honestly you won't know until you get the notice.

 

But if there's anything such as criminal history, previous marriages, etc.. They may be requesting additional documents for that.

09/11/2019: Entered USA through Chicago O'hare

09/20/2019: Married

10/09/2019: Filed AOS

11/12/2019: Biometric appointment

12/13/2019: RFE (birth certificate)

 

 

Total time spent together before K1 interview: 65 days.

NVC doesn't request more info from I-129fs.  USCIS does.  I think NVC discovered a USCIS error.  I agree the OP will just have to wait for the hard copy.

Yes, it is very rare that NVC sends back a 129F. It will be interesting to see what the error or additional requirements are.

Hello.

So, in the RFE notice they will send you, you’ll have a list of what type of evidences they want to see.

Right now, guessing is not a good thing to do. I’d suggest that you wait for that notice to get in your mail box and have what they need as soon as you can.

My bad, I meant USCIS.  Not the NVC. 🤣

 

But rest of my comment still stands true. It could be something as simple as a missed signature.  Although I think that'd be under Initial evidence and not additional.
